Chapter 714 of the Acts of 1977

[SECTION 3. AND BE IT FURTHER ENACTED, That the
provisions of this Act shall automatically terminate on
July 1, 1980 June 1, 1982.]

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect June 1, 1980.

AN ACT concerning

Courts - Consolidation of Cases

FOR the purpose of permitting the removal of certain cases
from the District Court to the circuit court and the
consolidation of these cases with certain cases in the
circuit court.

BY repealing and reenacting, with amendments,

Article - Courts and Judicial Proceedings

Section 6-104

Annotated Code of Maryland

(1974 Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Courts and Judicial Proceedings

6-104.

(A)  If a court finds that in the interest of
substantial justice an action should be heard in another
forum, the court may stay or dismiss the action in whole or
in part on any conditions it considers just.

(B) (1) WHEN ACTIONS INVOLVING AT LEAST ONE OF THE
SAME PARTIES, WITH THE SAME SUBJECT MATTER, ISSUES, AND
DEFENSES ARISING OUT OF THE SAME CIRCUMSTANCES, ARE
INSTITUTED IN THE DISTRICT COURT AND A CIRCUIT COURT OF THE
STATE, THE PARTY WHO FILED THE ACTION IN THE DISTRICT COURT
MAY FILE A MOTION IN THAT COURT TO REMOVE THE ACTION TO THE
CIRCUIT COURT FOR CONSOLIDATION WITH THE ACTION PENDING IN
CIRCUIT COURT.
