LAWS OF MARYLAND

Ch. 33

The present phrase "unless the context clearly
requires a different meaning" is deleted as
unnecessary.

The only other changes are in style.

See also § 1-101 of this article for other
applicable definitions.

(B)       AGENT.

(1)   "AGENT" MEANS A PERSON WHO IS AUTHORIZED BY
A LICENSEE TO ISSUE OR SELL DRAFTS UNDER THE NAME OF THE
LICENSEE AT ANY LOCATION OTHER THAN THE PLACE OF BUSINESS
SPECIFIED IN THE LICENSE.

(2)   "AGENT" DOES NOT INCLUDE A BRANCH OFFICE OF
A LICENSEE.

REVISOR'S NOTE: This subsection is new language derived

without substantive change from the seventh

paragraph of Art. 11, § 208, from the second

paragraph of Art. 11, § 212(3), except as that

paragraph relates to fees, and from Art. 11, §
216(d).

The phrase "under the name of the licensee" is
new language substituted for the references to
drafts "of the licensee" and to their sale or
issuance "under his or their or its name" for
clarity. This change conforms to the revision of
§ 12-404 of this subtitle, which prohibits
issuance or sale by a person who is not exempted
from licensing under this subtitle and is not a
licensee or an agent of a licensee.

The present references to "checks" and "money
orders" are deleted as unnecessary in light of
the definition of "draft" in subsection (c) of
this section.

The present reference to a "principal" licensee
is deleted as unnecessary.

(C)       DRAFT.

(1)        "DRAFT" MEANS AN ORDER FOR THE PAYMENT OR
TRANSMISSION OF MONEY.

(2)       "DRAFT"        INCLUDES A CHECK, MONEY ORDER,
TRAVELER'S CHECK, OR OTHER INSTRUMENT FOR THE PAYMENT OR
TRANSMISSION OF MONEY.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from the fourth
paragraph of Art. 11, § 208 and revised to
