reference to "traveler's check" is added for
clarity.
For simplicity, the term "draft" is substituted
as the defined term for the present "checks,
drafts and/or money orders".
(D) LICENSE.
"LICENSE" MEANS A LICENSE ISSUED BY THE BANK
COMMISSIONER UNDER THIS SUBTITLE TO ISSUE OR SELL DRAFTS FOR
A FEE OR SERVICE CHARGE.
REVISOR'S NOTE: This subsection presently appears as
the fifth paragraph of Art. 11, § 208.
The present references to "checks" and "money
orders" are deleted as unnecessary in light of
the definition of "draft" in subsection (c) of
this section.
The present reference to "the place or places of
business designated in the license" is deleted as
unnecessary under § 12—406 of this subtitle and,
as to the term "places", as erroneous given the
provisions of § 12-408(b)(3) of this subtitle.
The only other changes are in style.
REVISOR'S NOTE TO SECTION: The second sentence of the
first paragraph of present Art. 11, § 208, which
provides that the singular includes the plural,
is deleted as unnecessary in light of Art. 1, § 8
of the Code to the same effect.
The second paragraph of present Art. 11, § 208,
which defines "Person", is deleted as unnecessary
in light of the general definition of "person" in
§ 1-101 of this article to the same effect.
The third paragraph of present Art. 11, § 208,
which defines "Seller", is deleted as unnecessary
since the term is not used anywhere in this
subtitle.
The sixth paragraph of present Art. 11, § 208,
which defines "Licensee", is deleted as
unnecessary in light of the definition of
"License" in subsection (d) of this section.
The last paragraph of present Art. 11, § 208,
which defines "Commissioner", also is deleted as
