CHARTER AMENDMENT NO. 2-79

"RESIDENCY REQUIREMENT FOR COUNCIL MEMBERS AND MAYOR"

Resolution of the Town Council of the Town of Somerset
adopted pursuant to the authority of Article XI-E of the
Constitution of Maryland and Section 13 of Article 23A of
the Annotated Code of Maryland to amend Sections 83-4 and
83-14 of the Charter of the Town of Somerset as they appear
in the Montgomery County Code (1972) so as to reduce the
residency requirement for election to the offices of Council
Member and Mayor, respectively, from three years to eighteen
months.

WHEREAS, it is the desire of the Town Council to
encourage participation in Town government;

[Section(s) 83-4 and 83-14 of the Code of Public Local
Laws of Montgomery County, repealed and reenacted, with
amendments.

CITY CHARTER AMENDMENT

TO UPDATE CHARTER AMENDMENT
AND REFERENDUM PROCEDURE,
SECTION 1.31

WHEREAS, changes in the Maryland State Law and recent
court decisions have rendered portions of Section 1.31,
"Charter; amendment; referendum", of the City Charter
obsolete; and

WHEREAS, the Mayor and City Council deem it necessary
to bring the Charter amendment and referendum procedure in
compliance with State Law.

NOW, THEREFORE, BE IT RESOLVED AND ORDAINED BY THE
MAYOR AND COUNCIL OF THE CITY OF TAKOMA PARK, MARYLAND
