department shall require an affidavit from
the applicant and may require pertinent
documentary evidence including (a)
information relating to motor fuel
consumption and (b) business, medical,
governmental or social service records or
certification showing that issuance of a
certificate is warranted under the above
standard; hearings on denials of
certificates shall be granted, on request,
in accordance with Section 12-203 of the
Transportation Article and appeals shall
lie in accordance with Section 12-209 of
the Transportation Article;
(h) Vehicles operated by judges and jurors
of any court in this State required to
drive more than 75 miles between their home
and court, upon presentation of proper
identification and an affidavit;
(i) Equipment designed and used primarily
for construction sites, equipment designed
and used primarily as farm equipment in
agricultural production;
(j) Company van pool vehicles, as defined
in Article 78, Section 2 (jj), and vans
bearing VP license plates issued to van
pools by the Department of Transportation.
II.
MINIMUM PURCHASE PROGRAM
1. No sale or purchase of gasoline for a vehicle
shall be made for less than five dollars, if the
vehicle contains less than six cylinders or, for
less than seven dollars, if the vehicle contains
six cylinders or more. Minimum purchase
requirements shall not apply to motorcycles or
mopeds as defined in Sections 11-136 and 11-130.1
of the Transportation Article or to container
sales as referred to in paragraph 2 below or to
any vehicle having a fuel tank capacity of eight
gallons or less.
2. Not more than 2 gallons of gasoline may at
anytime be sold or purchased for delivery into a
container other than the fuel tank of a vehicle
to be transported away from the premises of the
retail seller, except for use in agriculture as
certified by the local Agricultural Stabilization
and Conservation Service Office or for use in
commercial machinery pursuant to a certificate
