issued by the Maryland State Police, the
Baltimore City Police Department, or a County
Police Department as to continuing need for such
use. Nothing in this paragraph shall be
construed to authorize the sale of gasoline in
any container not satisfying applicable safety
requirements.
3. No gasoline storage tank shall be constructed
at, and no gasoline shall be delivered into a
storage tank situated at any property utilized
solely as a personal residence.
III.
STAGGERED HOURS, PUBLIC INFORMATION
1. The retail station dealers are authorized and
directed to develop and submit to the Secretary
of Natural Resources or his designee, and with
his approval to implement, a plan for the
staggered opening of retail stations for the
protection and convenience of the motoring
public.
2. The retail station dealers, their suppliers,
and the Secretary or his designee are authorized
to develop a program for informing the motoring
public of the hours at which stations are open
for the purchase of gasoline, and the products
and related services which are available during
those hours or other hours.
IV.
SANCTIONS
1. Any violation of this Order shall be
punishable as a misdemeanor and shall subject the
offender to a fine of not more than one hundred
dollars ($100.00) upon conviction thereof.
Pursuant to my constitutional authority to nolle
prosse criminal charges and to grant reprieves
and pardons provided in Article II, Section 20 of
the Constitution of Maryland, I hereby direct the
police and prosecuting officials of the State and
local governments not to prosecute technical
violations of this Order occasioned by emergency
situations.
2. Peace Officers are authorized to issue
citations in accordance with § 26-201 of the
Transportation Article and Maryland District Rule
710(b) for alleged criminal violations of this
Executive Order. Such citations may be stated on
the uniform form for motor vehicle citations.
