legislation which is being considered by several states and
which is presently the subject of a growing amount of
litigation. As you will recall, in order to provide me with
an alternative should the model act have been declared to
have been unconstitutional subsequent to sine die and prior
to the last bill signing, the House amended House Bill 405
to provide for an entirely different approach to the
regulation and prohibition of the growing problem of the use
and sale of drug paraphernalia.
To date, the model act has survived constitutional
attack in the courts. Moreover, in his review of the two
bills, the Attorney General indicates that the model act
presents less constitutional and statutory construction
problems than the alternative presented by House Bill 405.
For these reasons, I have decided to veto House Bill
405.

AN ACT concerning
Garrett County - Hospital Bonds
FOR the purpose of authorizing and empowering the County
Commissioners of Garrett County, from time to time, to
borrow not more than Six Million Dollars ($6,000,000)
in order to assist in financing the expansion,
reconstruction, rehabilitation, renovation, and
improvement of the Garrett County Memorial Hospital,
including the costs of development of property rights,
acquisition and installation of furnishings and
equipment, and any related planning, architectural, and
engineering services, and to effect such borrowing by
the issuance and sale at public or private sale of its
general obligation bonds in like par amount; empowering
the County to fix and determine, by resolution, the
form, tenor, interest rate or rates or method of
determining the same, terms, conditions, maturities,
and all other details incident to the issuance and sale
of the bonds; empowering the County to issue refunding
bonds for the purchase or redemption of bonds in
advance of maturity; empowering and directing the
County to enter into an agreement with the Board of
