VETOES
FOR the purpose of defining drug paraphernalia; specifying
certain criteria and factors to be considered in
determining if something is drug paraphernalia;
prohibiting the use, or possession with the intent to use
drug paraphernalia; prohibiting the possession or
delivery of drug paraphernalia for certain purposes;
providing a separate offense with more severe penalties
for delivery of drug paraphernalia by a person of a
certain age to a minor; prohibiting a person from
sponsoring an advertisement for drug paraphernalia
objects; providing for the forfeiture of property which
is drug paraphernalia or controlled paraphernalia; and
specifying certain penalties for violations of the
provisions of this Act.
Drug Accessories
FOR the purpose of providing that it is unlawful to
manufacture, distribute, sell, or offer for sale
certain items designed, intended, or adapted for use
with certain illegal drugs and substances; defining
drug accessories; specifying criteria and factors to be
considered by a court in determining if an item is a
drug accessory; providing for a court hearing to
determine if an item is a drug accessory; authorizing a
court to issue a ruling restraining the manufacture,
distribution, sale, or offering for sale of drug
accessories; providing certain criminal penalties;
specifying for a procedure to enjoin persons from
manufacturing, distributing, selling, or offering for
sale drug accessories; providing for the seizure and
forfeiture of drug accessories; generally relating to
procedures and criminal sanctions to prohibit the
manufacture, distribution, sale, or offering for sale
of items designed, intended, or adapted for use with
certain illegal drugs and substances; providing that
this Act does not preclude local authorities from
enacting laws pertaining to drug parphernalia and drug
accessories; declaring the provisions of this Act to be
severable; and declaring this Act is an emergency
measure to take effect from the date of its passage.
