AN ACT concerning
Railroad Safety and Health
FOR the purpose of providing for the inspection and
regulation of safety and health conditions relating to
railroad operations in the State; providing for the
transfer to the Division of Labor and Industry of
functions, personnel, and enforcement under certain
laws; empowering the Commissioner of Labor and Industry
to administer and enforce provisions as to railroad
safety and health, to prescribe rules and regulations,
to inspect railroad facilities and equipment, to issue
citations for violations, to accept federal grants, and
to order the cessation of operation of any railroad not
in compliance with certain provisions; defining terms;
providing for civil and criminal penalties; and
relating generally to safety and health conditions in
railroad operations.

Section 82 through 98 99, inclusive, to be under the
new subtitle "Railroad Safety and Health"

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

RAILROAD SAFETY AND HEALTH
82.
(A) THE GENERAL ASSEMBLY OF MARYLAND FINDS THAT THE
OPERATION OF UNSAFE AND DEFECTIVE RAILROADS IMPOSES
SUBSTANTIAL PROBABILITY OF SERIOUS AND PREVENTABLE INJURIES
AND DAMAGES TO PERSONS AND PROPERTY EXPOSED TO THE UNSAFE
CONDITIONS, AND THE PREVENTION OF THESE INJURIES AND
PROTECTION FROM EXPOSURE TO THE UNSAFE CONDITIONS IS IN THE
BEST INTEREST AND WELFARE OF THE PEOPLE OF THE STATE; AND
(B) IT IS THE INTENT AND PURPOSE OF THIS SUBTITLE TO
PROMOTE SAFETY AND HEALTH IN ALL AREAS OF RAILROAD
OPERATIONS, TO REDUCE RAILROAD RELATED ACCIDENTS, TO REDUCE
DEATHS AND INJURIES TO ALL PERSONS, TO REDUCE DAMAGE TO
PROPERTY CAUSED BY ACCIDENTS INVOLVING RAILROADS, AND TO
ASSURE AS FAR AS POSSIBLE IN THE OPERATION OF RAILROADS IN
THE STATE, THE SAFETY AND HEALTH OF ALL PERSONS AND THE
