PROTECTION OF PROPERTY BY:
(1) PROVIDING AN EFFECTIVE ENFORCEMENT AND
COMPLIANCE PROGRAM;
(2) PROVIDING FOR THE DEVELOPMENT AND
PROMULGATION OF SAFETY AND HEALTH STANDARDS AND REGULATIONS;
AND
(3) PROVIDING FOR APPROPRIATE REPORTING
PROCEDURES WITH RESPECT TO SAFETY AND HEALTH IN RAILROAD
OPERATIONS TO HELP ACHIEVE THE OBJECTIVE OF THIS SUBTITLE
AND TO ACCURATELY DESCRIBE THE NATURE OF RAILROAD SAFETY AND
HEALTH HAZARDS AND PROBLEMS.
83.
FOR THE PURPOSES OF THIS SUBTITLE:
(1) "COMMISSIONER" MEANS THE COMMISSIONER OF
LABOR AND INDUSTRY OR HIS AUTHORIZED REPRESENTATIVE.
(2) "RAILROAD COMPANY" MEANS THE OWNER OR
OPERATOR OF A RAILROAD OPERATING IN THE STATE OF MARYLAND,
AND THE STATE, AND ITS POLITICAL SUBDIVISIONS.
(3) "WORKING DAYS" MEANS MONDAY THROUGH FRIDAY
BUT DOES NOT INCLUDE SATURDAY, SUNDAY, OR STATE HOLIDAYS.
(4) "EMPLOYEE" INCLUDES EVERY PERSON IN THE
SERVICE OF A CARRIER (SUBJECT TO ITS CONTINUING AUTHORITY TO
SUPERVISE AND DIRECT THE MANNER OF RENDITION OF HIS SERVICE)
WHO PERFORMS ANY WORK DEFINED AS THAT OF AN EMPLOYEE OR
SUBORDINATE OFFICIAL IN THE ORDERS OF THE INTERSTATE
COMMERCE COMMISSION NOW IN EFFECT, AND AS THE SAME MAY BE
AMENDED OR INTERPRETED BY ORDERS HEREAFTER ENTERED BY THE
COMMISSION PURSUANT TO THE AUTHORITY WHICH IS CONFERRED UPON
IT TO ENTER ORDERS AMENDING OR INTERPRETING SUCH EXISTING
ORDERS.
(5) "RAILROAD" INCLUDES EVERY COMMON CARRIER BY
RAIL, HOWEVER POWERED, WITH ALL BRANCHES, BRIDGES, CARS,
EXTENSIONS, FERRIES, PLANTS, SPURS, STATIONS, SUBWAYS,
SWITCHES, TERMINAL FACILITIES, TRACKS, TUNNELS, AND
EQUIPMENT USED THEREON OR IN CONNECTION THEREWITH.
84.
(A) THE COMMISSIONER OF LABOR AND INDUSTRY SHALL:
(1) ADMINISTER AND ENFORCE THE PROVISIONS OF
THIS SUBTITLE;
(2) PROMULGATE, AS NECESSARY, APPROPRIATE
STANDARDS, RULES, AND REGULATIONS RELATING TO ALL AREAS OF
RAILROAD SAFETY AND HEALTH;
