However, nothing in this section may be construed to be a
waiver of the Commission's total governmental immunity.
THIS SUBSECTION IS INTENDED TO INCLUDE ALSO ALL CLAIMS
PENDING ON JUNE 1, 1978 SO LONG AS DUE NOTICE WAS GIVEN
PURSUANT TO SECTION 5-306 OF THE COURTS AND JUDICIAL
PROCEEDINGS ARTICLE, AND FURTHER , PROVIDED THAT AN
INSURANCE POLICY TO COVER SUCH LIABILITY WAS IN EFFECT AT
THE TIME THE CLAIM WAS FILED ACCRUED.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.

CHAPTER 745

(Senate Bill 1039)

AN ACT concerning

Public Education - Handicapped Children

FOR the purpose of providing that the counties plan for
special education services for handicapped children
shall include certain children in day-care centers; and
requiring the State Superintendent to allow a
handicapped child to remain in a day-care center for a
certain fiscal year.

BY repealing and reenacting, with amendments,

Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Education

8-404.

(b) (1) Each plan shall provide for the education of
all handicapped children, including:

(i) Those who are severely handicapped,
whose parents or guardians are domiciled in the county; and
