(a) In this subtitle the following words have the
meanings indicated.

(K) "FINANCIAL INTEREST" MEANS:

(1)  AN ASSET WITH A FAIR MARKET VALUE OF $1,000
OR MORE IN A CALENDAR YEAR; OR

(2)  A SOURCE OF INCOME OF $500 OR MORE IN A
CALENDAR YEAR.

(L) "HOUSEHOLD MEMBER" MEANS:

(1)  A PERSON'S SPOUSE, SON, DAUGHTER, WARD,
FINANCIALLY DEPENDENT PARENT, OR OTHER RELATIVE WHO SHARES
THE PERSON'S LEGAL RESIDENCE; OR

(2)  A PERSON'S SON, DAUGHTER, WARD, PARENT, OR
OTHER RELATIVE OVER WHOSE FINANCIAL AFFAIRS THE PERSON HAS
LEGAL OR ACTUAL CONTROL.

(a) (1) The Board consists of five members [each].
EACH OCCUPATIONAL THERAPIST AND OCCUPATIONAL THERAPY
ASSISTANT MEMBER SHALL BE appointed by the Governor on the
recommendation of the Secretary of Health and Mental Hygiene
from a list of nominees presented by the Maryland
Occupational Therapy Association. THE CONSUMER MEMBER SHALL
BE APPOINTED BY THE GOVERNOR ON THE RECOMMENDATION OF THE
SECRETARY OF HEALTH AND MENTAL HYGIENE AND WITH THE ADVICE
AND CONSENT OF THE SENATE.

(2) Of the five Board members:

(i) Three shall be licensed occupational
therapists;

(ii) One shall be a licensed occupational
therapy assistant; and

(iii) One shall be a [public] CONSUMER
member who [is not an occupational therapist or occupational
therapy assistant.]:

1.  IS QUALIFIED TO REPRESENT THE
INTERESTS OF CONSUMERS A MEMBER OF THE GENERAL PUBLIC;

2.  HAS NEVER BEEN AN OCCUPATIONAL
THERAPIST, OCCUPATIONAL THERAPY ASSISTANT, OCCUPATIONAL
THERAPIST-IN-TRAINING, OR OCCUPATIONAL THERAPY
ASSISTANT-IN-TRAINING, NOR HAS A HOUSEHOLD MEMBER WHO IS AN
OCCUPATIONAL THERAPIST, OCCUPATIONAL THERAPY ASSISTANT,
OCCUPATIONAL THERAPIST-IN-TRAINING, OR OCCUPATIONAL THERAPY
ASSISTANT-IN-TRAINING;
