(2) The Board shall consist of five members who
shall be appointed by the Governor, one of whom shall be
selected from a list of nominees presented by the Maryland
Chapter of the National Association of Social Workers, Inc.,
one from a list of nominees presented by the Metropolitan
Washington Chapter of the National Association of Social
Workers.
(3) The lists of nominees shall contain three
names for each vacancy.
(4) All members of the Board shall be residents
of this State.
(5) THE CONSUMER MEMBER SHALL BE APPOINTED BY
THE GOVERNOR, UPON THE RECOMMENDATION OF THE SECRETARY OF
HEALTH AND MENTAL HYGIENE, AND WITH THE ADVICE AND CONSENT
OF THE SENATE.
(b) (1) Four of the members shall be licensed under
the provisions of this subtitle, except that the members
constituting the first Board shall be persons eligible for
licensing as social workers as provided in this subtitle.
(2) One member shall be selected from and
represent [the general public] CONSUMERS AND THIS MEMBER
SHALL:
(I) BE QUALIFIED TO REPRESENT THE
INTERESTS OF CONSUMERS A MEMBER OF THE GENERAL PUBLIC;
(II) HAVE NEVER BEEN A SOCIAL WORKER OR A
SOCIAL WORKER-IN-TRAINING, NOR HAVE A HOUSEHOLD MEMBER WHO
IS A SOCIAL WORKER OR SOCIAL WORKER-IN-TRAINING;
(III) HAVE NEVER PARTICIPATED IN A RELATED
COMMERCIAL OR PROFESSIONAL FIELD, NOR HAVE A HOUSEHOLD
MEMBER WHO PARTICIPATES IN A RELATED COMMERCIAL OR
PROFESSIONAL FIELD; AND
(IV) HAVE NOT WITHIN 2 YEARS PRIOR TO
APPOINTMENT NOR DURING THE TERM OF APPOINTMENT HAD A
FINANCIAL INTEREST IN AN INDIVIDUAL, ASSOCIATION,
CORPORATION, OR ANY OTHER ENTITY WHICH IS REGULATED BY THE
BOARD.
(3) A CONSUMER MEMBER MAY NOT PARTICIPATE IN
ACTIVITIES RELATING TO EXAMINATIONS UNLESS APPROVED BY THE
BOARD. [These members of the first Board eligible for
licensing may continue to serve until the expiration of
their term or July 1, 1977, whichever comes sooner unless
their license has been issued in which case they shall serve
until the expiration of their term.]
