(II) A PERSON'S SON, DAUGHTER, WARD,
PARENT, OR OTHER RELATIVE OVER WHOSE FINANCIAL AFFAIRS THE
PERSON HAS LEGAL OR ACTUAL CONTROL.

769.

(a) There is hereby created the Maryland State Board
of Examiners of Nursing Home Administrators, which shall
consist of [nine(9)] TEN TEN members. The Board shall
be part of the Department of Health and Mental Hygiene and
make reports directly to the Secretary of that Department at
the times he prescribes. The Board shall be appointed by
the Governor, upon the recommendation of the Secretary of
Health and Mental Hygiene from a list of nominees selected
by the Secretary after consultation with the associations
and societies appropriate to the disciplines and professions
representative of the vacancies to be filled[, and it]. THE
CONSUMER MEMBERS SHALL BE APPOINTED WITH THE ADVICE AND
CONSENT OF THE SENATE. THE BOARD shall consist of the
following members:

(1)  Four (4) members actively engaged in the
management and operation of either a proprietary or
nonprofit nursing home or homes as administrator with five
years' experience in such operation, who are licensed, or in
the case of initial appointments are eligible for licensure
under this subtitle;

(2)  Four (4) THREE FOUR members, other than
nursing home administrators, who are actively engaged in
professions concerned with the care of the chronically ill
or of infirm or aged patients; and

(3)  [One (1) member frond the general public who
is not engaged in the management, ownership (in whole or in
part), operation, or supervision of any nursing home or
hospital.] TWO MEMBERS SHALL BE CONSUMERS WHO:

(I)  ARE QUALIFIED TO REPRESENT THE

INTERESTS OF CONSUMERS MEMBERS OF THE GENERAL PUBLIC;

(II)  HAVE NEVER BEEN A NURSING HOME
ADMINISTRATOR OR NURSING HOME ADMINISTRATOR-IN-TRAINING, NOR
HAVE A HOUSEHOLD MEMBER WHO IS A NURSING HOME ADMINISTRATOR
OR NURSING HOME ADMINISTRATOR-IN-TRAINING;

(III)  HAVE NEVER PARTICIPATED IN A RELATED
COMMERCIAL OR PROFESSIONAL FIELD, NOR HAVE A HOUSEHOLD
MEMBER WHO PARTICIPATES IN A RELATED COMMERCIAL OR
PROFESSIONAL FIELD;

(IV)  HAVE NOT WITHIN 2 YEARS PRIOR TO
APPOINTMENT NOR DURING THE TERM OF APPOINTMENT HAD A
FINANCIAL INTEREST IN AN INDIVIDUAL, ASSOCIATION,
UNINCORPORATED ASSOCIATION, CORPORATION, OR ANY OTHER ENTITY
WHICH IS REGULATED BY THE BOARD; AND
