(D) "FINANCIAL INTEREST" MEANS:
(1) AN ASSET WITH A FAIR MARKET VALUE OF $1,000
OR MORE IN A CALENDAR YEAR; OR
(2) A SOURCE OF INCOME OF $500 OR MORE IN A
CALENDAR YEAR.
(E) "HOUSEHOLD MEMBER" MEANS:
(1) A PERSON'S SPOUSE, SON, DAUGHTER, WARD,
FINANCIALLY DEPENDENT PARENT, OR OTHER RELATIVE WHO SHARES
THE PERSON'S LEGAL RESIDENCE; OR
(2) A PERSON'S SON, DAUGHTER, WARD, PARENT, OR
OTHER RELATIVE OVER WHOSE FINANCIAL AFFAIRS THE PERSON HAS
LEGAL OR ACTUAL CONTROL.

(A) The State Board of Examiners of Psychologists
whose duty it is to administer the provisions of this
subtitle is hereby established as part of the Department of
Health and Mental Hygiene.
(B) The Board shall consist of SIX MEMBERS, five OF
WHICH SHALL BE psychologists, [who shall be] appointed by
the Governor, upon the recommendation of the Secretary of
Health and Mental Hygiene, from a list of nominees presented
by the Maryland Psychological Association, Inc., with the
advice and consent of the Senate of Maryland.
(C) ONE MEMBER SHALL BE A CONSUMER, WHO SHALL BE
APPOINTED BY THE GOVERNOR, UPON THE RECOMMENDATION OF THE
SECRETARY OF HEALTH AND MENTAL HYGIENE, WITH THE ADVICE AND
CONSENT OF THE SENATE OF MARYLAND, AND WHO:
(1) IS QUALIFIED TO REPRESENT THE INTERESTS OF
CONSUMERS A MEMBER OF THE GENERAL PUBLIC:
(2) HAS NEVER BEEN A PSYCHOLOGIST OR A
PSYCHOLOGIST-IN-TRAINING, NOR HAS A HOUSEHOLD MEMBER WHO IS
A PSYCHOLOGIST OR PSYCHOLOGIST-IN-TRAINING;
(3) HAS NEVER PARTICIPATED IN A RELATED
COMMERCIAL OR PROFESSIONAL FIELD, NOR HAS A HOUSEHOLD MEMBER
WHO PARTICIPATES IN A RELATED COMMERCIAL OR PROFESSIONAL
FIELD;
(4) HAS NOT WITHIN 2 YEARS PRIOR TO APPOINTMENT,
NOR DURING THE TERM OF APPOINTMENT, HAD A FINANCIAL INTEREST
IN AN INDIVIDUAL, ASSOCIATION, UNINCORPORATED ASSOCIATION,
CORPORATION, OR ANY OTHER ENTITY WHICH IS REGULATED BY THE
BOARD; AND
(5) MAY NOT PARTICIPATE IN ACTIVITIES RELATING
TO EXAMINATIONS UNLESS APPROVED BY THE BOARD. [The members
