(I) IS or QUALIFIED TO REPRESENT THE
INTERESTS OF CONSUMERS A MEMBER OF THE GENERAL PUBLIC;
(II) HAS NEVER BEEN A PHYSICAL THERAPIST,
PHYSICAL THERAPIST ASSISTANT, PHYSICAL
THERAPIST-IN-TRAINING, OR PHYSICAL THERAPIST
ASSISTANT-IN-TRAINING, NOR HAS A HOUSEHOLD MEMBER WHO IS A
PHYSICAL THERAPIST, PHYSICAL THERAPIST ASSISTANT, PHYSICAL
THERAPIST-IN-TRAINING, OR PHYSICAL THERAPIST
ASSISTANT-IN-TRAINING;
(III) HAS NEVER PARTICIPATED IN A RELATED
COMMERCIAL OR PROFESSIONAL FIELD, NOR HAS A HOUSEHOLD MEMBER
WHO PARTICIPATES IN A RELATED COMMERCIAL OR PROFESSIONAL
FIELD;
(IV) HAS NOT WITHIN 2 YEARS PRIOR TO
APPOINTMENT NOR DURING THE TERM OF APPOINTMENT HAD A
FINANCIAL INTEREST IN AN INDIVIDUAL, ASSOCIATION,
UNINCORPORATED ASSOCIATION, CORPORATION, OR ANY OTHER ENTITY
WHICH IS REGULATED BY THE BOARD; AND
(V) MAY NOT PARTICIPATE IN ACTIVITIES
RELATING TO EXAMINATIONS UNLESS APPROVED BY THE BOARD.
(5) Members of the Board shall be appointed by
the Governor, upon the recommendation of the Secretary of
Health and Mental Hygiene, for terms of five years each and
until their successors are appointed AND THE APPOINTMENT OF
THE CONSUMER MEMBER SHALL BE WITH THE ADVICE AND CONSENT OF
THE SENATE.
(6) All appointments shall be made as terms on
the Board respectively expire (other than by abolition of
positions) and so as to preserve the composition of the
Board.
(7) Each appointment OF A PHYSICAL THERAPIST
MEMBER shall be made from lists of qualified persons
submitted to the Governor and the Secretary of Health and
Mental Hygiene by the American Physical Therapy Association
of Maryland and shall contain not less than three names for
each appointment to be made.
(8) Vacancies shall be filled by the Governor,
upon the recommendation of the Secretary of Health and
Mental Hygiene, for the unexpired term in the manner
provided in this subsection.
(b) A quorum of the Board for the transaction of
business shall be [three] FOUR members.
