submit the list, the Governor, upon the recommendation of
the Secretary of Health and Mental Hygiene, shall appoint
members in good standing of the association who are
otherwise qualified to serve. UPON THE RECOMMENDATION OF
THE SECRETARY OF HEALTH AND MENTAL HYGIENE, AND WITH THE
ADVICE AND CONSENT OF THE SENATE, THE GOVERNOR SHALL APPOINT
ONE CONSUMER MEMBER.

482.

(a)  There is a State Board of Podiatry Examiners which
is a part of the Department of Health and Mental Hygiene. It
consists of five registered and practicing podiatrists of
recognized ability and honor AND ONE CONSUMER MEMBER. Each
[Board] PODIATRIST member is a resident of the State and has
been in active practice in the State for at least five years
immediately preceding his appointment. THE CONSUMER MEMBER:

(1)  SHALL BE QUALIFIED TO REPRESENT THE

INTERESTS OF CONSUMERS A MEMBER OF THE GENERAL PUBLIC;

(2)  SHALL NEVER HAVE BEEN A PODIATRIST OR
PODIATRIST-IN-TRAINING, NOR HAVE A HOUSEHOLD MEMBER WHO IS A
PODIATRIST OR PODIATRIST-IN-TRAINING;

(3)  SHALL NEVER HAVE PARTICIPATED IN A RELATED
COMMERCIAL OR PROFESSIONAL FIELD, NOR HAVE A HOUSEHOLD
MEMBER WHO PARTICIPATES IN A RELATED COMMERCIAL OR
PROFESSIONAL FIELD;

(4)  SHALL HAVE NOT WITHIN 2 YEARS PRIOR TO
APPOINTMENT NOR DURING THE TERM OF APPOINTMENT HAD A
FINANCIAL INTEREST IN AN INDIVIDUAL, ASSOCIATION,
UNINCORPORATED ASSOCIATION, CORPORATION, OR ANY OTHER ENTITY
WHICH IS REGULATED BY THE BOARD; AND

(5)  MAY NOT PARTICIPATE IN ACTIVITIES RELATING
TO EXAMINATIONS UNLESS APPROVED BY THE BOARD.

(b)  The Governor, with the advice of the Secretary of
Health and Mental Hygiene, shall appoint a successor to each
PODIATRIST member of the present Board upon the expiration
of their terms or a vacancy in office, from a list of
qualified podiatrists of double the number of vacancies to
be filled submitted by the Maryland Podiatry Association and
the Board of Podiatry Examiners. UPON THE RECOMMENDATION OF
THE SECRETARY OF HEALTH AND MENTAL HYGIENE, AND WITH THE
ADVICE AND CONSENT OF THE SENATE, THE GOVERNOR SHALL APPOINT
THE CONSUMER MEMBER TO THE BOARD.

(1) The list submitted by the Maryland Podiatry
Association shall be chosen by a majority vote of the
association members at a meeting called for that purpose.
The secretary of the association shall mail in advance two
weeks notice of the meeting, stating the time, place and
purpose of the meeting to the members of the association at
their respective addresses appearing in the association's
records.
