(2) A PERSON'S SON, DAUGHTER, WARD, PARENT, OR
OTHER RELATIVE OVER WHOSE FINANCIAL AFFAIRS THE PERSON HAS
LEGAL OR ACTUAL CONTROL.

369.

(a)  There is a Board of Examiners in Optometry in the
Department.

(b)  The Board consists of [five] SIX members. The
Governor, on recommendation of the Secretary, shall appoint
each OPTOMETRIST member from a list of three names submitted
by the Maryland Optometric Association. Each OPTOMETRIST
member shall have for a period of five years before
appointment, resided in this State and actively and
continuously engaged in the practice of optometry in this
State. UPON THE RECOMMENDATION OF THE SECRETARY, AND WITH
THE ADVICE AND CONSENT OF THE SENATE, THE GOVERNOR SHALL
APPOINT ONE CONSUMER MEMBER WHO:

(1)  IS QUALIFIED TO REPRESENT THE INTERESTS OF
CONSUMERS A MEMBER OF THE GENERAL PUBLIC;

(2)  HAS NEVER BEEN AN OPTOMETRIST OR
OPTOMETRIST-IN-TRAINING, NOR HAS A HOUSEHOLD MEMBER WHO IS
AN OPTOMETRIST OR OPTOMETRIST-IN-TRAINING;

(3)  HAS NEVER PARTICIPATED IN A RELATED
COMMERCIAL OR PROFESSIONAL FIELD, NOR HAS A HOUSEHOLD MEMBER
WHO PARTICIPATES IN A RELATED COMMERCIAL OR PROFESSIONAL
FIELD;

(4)  HAS NOT WITHIN 2 YEARS PRIOR TO APPOINTMENT
NOR DURING THE TERM OF APPOINTMENT HAD A FINANCIAL INTEREST
IN AN INDIVIDUAL, ASSOCIATION, UNINCORPORATED ASSOCIATION,
CORPORATION, OR ANY OTHER ENTITY WHICH IS REGULATED BY THE
BOARD; AND

(5)  MAY NOT PARTICIPATE IN ACTIVITIES RELATING
TO EXAMINATIONS UNLESS APPROVED BY THE BOARD.

467.

(A) There is a Board of Osteopathic Examiners in the
Department of Health and Mental Hygiene. The Board shall
consist of [five] SIX members. The members shall serve for a
term of three years from the first day of June, next after
his appointment[, except the original appointees, who
served, from June 1, 1914, as follows: two for one year, two
for two years, and one for three years]. Each OSTEOPATH
OSTEOPATHIC PHYSICIAN member shall be a graduate of a
college or university accredited by the American Osteopathy
Association, licensed to practice osteopathy under the laws
of this State and shall have engaged in the practice for at
least three years prior to his appointment. A member may not
be in any manner financially interested in or connected with
