EMBALMER-IN-TRAINING, NOR HAVE A HOUSEHOLD MEMBER WHO IS A
FUNERAL DIRECTOR, EMBALMER, FUNERAL DIRECTOR-IN-TRAINING, OR
EMBALMER-IN-TRAINING;
(III) HAVE NEVER PARTICIPATED IN A RELATED
COMMERCIAL OR PROFESSIONAL FIELD, NOR HAVE A HOUSEHOLD
MEMBER WHO PARTICIPATES IN A RELATED COMMERCIAL OR
PROFESSIONAL FIELD;
(IV) HAVE NOT WITHIN 2 YEARS PRIOR TO
APPOINTMENT NOR DURING THE TERM OF APPOINTMENT HAD A
FINANCIAL INTEREST IN AN INDIVIDUAL, ASSOCIATION,
UNINCORPORATED ASSOCIATION, CORPORATION, OR ANY OTHER ENTITY
WHICH IS REGULATED BY THE BOARD; AND
(V) MAY NOT PARTICIPATE IN ACTIVITIES
RELATING TO EXAMINATIONS UNLESS APPROVED BY THE BOARD.
(C) [five of whom] FIVE MEMBERS shall be residents of
Baltimore City and six MEMBERS SHALL BE residents of the
counties[, who, together with the Commissioner of Health].
(D) SECRETARY OF HEALTH AND MENTAL HYGIENE, or some
person designated by the [said Commissioner] SECRETARY,
SHALL SERVE as an ex officio member[,].
(E) THESE MEMBERS shall constitute the State Board of
Funeral Directors and Embalmers of Maryland, and they shall
take oath prescribed by the Constitution of Maryland.
(F) The members of the said Board shall hold office
for a term of four (4) years or until their successors are
duly appointed and qualified; EXCEPT THAT THE INITIAL TERM
OF ONE CONSUMER MEMBER SHALL BE 3 YEARS, AND THE INITIAL
TERM OF THE OTHER CONSUMER MEMBER SHALL BE 4 YEARS[: any].
(G) ANY vacancy or vacancies occurring in the
membership of the said Board appointed by the Governor shall
be filled by the Governor, upon the recommendations of the
Secretary of Health and Mental Hygiene and by and with the
advice and consent of the Senate of Maryland.

(G) "FINANCIAL INTEREST" MEANS:
(1) AN ASSET WITH A FAIR MARKET VALUE OF $1,000
OR MORE IN A CALENDAR YEAR; OR
(2) A SOURCE OF INCOME OF $500 OR MORE IN A
CALENDAR YEAR.
(H) "HOUSEHOLD MEMBER" MEANS:
(1) A PERSON'S SPOUSE, SON, DAUGHTER, WARD,
FINANCIALLY DEPENDENT PARENT, OR OTHER RELATIVE WHO SHARES
THE PERSON'S LEGAL RESIDENCE; OR
