the State for reimbursement. All moneys collected by the
Board shall be paid over to the State Treasurer, and shall
become general funds of the State. These moneys shall be
disbursed by the Comptroller only pursuant to an
appropriation made in accordance with §§ 32 and 52 of
Article 3 of the Constitution or pursuant to the provisions
of §§ 1 through 15, inclusive, of Article 15A of the Code,
title "Budget and Fiscal Planning," as amended from time to
time.

A board composed of [ten] 11 members is hereby created
and established, to be known as the State Board of Funeral
Directors and Embalmers of Maryland, to be part of the
Department of Health and Mental Hygiene, and the powers and
duties of the said Board prescribed.

340.

(A)  IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(1)  "FINANCIAL INTEREST" MEANS:

(I)  AN ASSET WITH A FAIR MARKET VALUE OF
$1,000 OR MORE IN A CALENDAR YEAR; OR

(II)  A SOURCE OF INCOME OF $500 OR MORE IN
A CALENDAR YEAR.

(2)  "HOUSEHOLD MEMBER" MEANS:

(I)  A PERSON'S SPOUSE, SON, DAUGHTER,
WARD, FINANCIALLY DEPENDENT PARENT, OR OTHER RELATIVE WHO
SHARES THE PERSON'S LEGAL RESIDENCE; OR

(II)  A PERSON'S SON, DAUGHTER, WARD,
PARENT, OR OTHER RELATIVE OVER WHOSE FINANCIAL AFFAIRS THE
PERSON HAS LEGAL OR ACTUAL CONTROL.

(B)  The Governor, upon the recommendations of the
Secretary of Health and Mental Hygiene, and by and with the
advice, and consent of the Senate of Maryland shall appoint:

(1)  [eleven] NINE licensed funeral directors and
embalmers, residents of the State of Maryland, who shall
have been actively engaged in their profession for the last
five years immediately preceding their appointment[,]; AND

(2)  TWO CONSUMER MEMBERS WHO:

(I)  ARE QUALIFIED TO REPRESENT THE

INTERESTS OF CONSUMER MEMBERS OF THE GENERAL PUBLIC;

(II)  HAVE NEVER BEEN A FUNERAL DIRECTOR,
EMBALMER, FUNERAL DIRECTOR-IN-TRAINING, OR
