parking spaces for the use of handicapped persons; and

repealing the authority of the Motor Vehicle

Administration to designate and regulate parking spaces
for the use of handicapped persons.

FOR the purpose of providing that in Baltimore County, the
Baltimore County department of Traffic Engineering
shall have the authority to approve the designation of
parking spaces for use by certain handicapped
individuals; and granting certain authority to local
authorities regarding parking spaces for handicapped

citizens.

BY repealing and reenacting, with amendments,

Article - Transportation

Section 21-1005, 21-1006(b), and 25-102(a)

Annotated Code of Maryland

(1977 Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Transportation

21-1005.

(a)  A person who has a permanent physical disability
may apply to [the Administration] A LOCAL AUTHORITY, on
the form that it requires, for a permit for one reserved
parking space:

(1)  To be located at the curb, side, or edge of
the roadway of the highway in front of or near his dwelling
house WITHIN THE JURISDICTION OF THE LOCAL AUTHORITY; and

(2)  To provide convenience and safety as the
person enters or leaves his vehicle or that of another.

(b)  The [Administration] LOCAL AUTHORITY shall issue
the permit:

(1)  If the applicant is required to use a
wheelchair to move about or if the [Administration] LOCAL
AUTHORITY determines that the disability is so severe that
the applicant would endure a hardship or be subject to a
risk of injury if the applicant should enter or leave the
vehicle at a less convenient location; and

(2)  If the [Administration] LOCAL AUTHORITY
determines that the physical disability is permanent.

(c) On receipt of the permit, the person shall affix
it to his vehicle in a conspicuous place.
