(IV) STARTS AND STOPS PUMPS, ENGINES, AND

GENERATORS TO CONTROL AND ADJUST FLOW AND TREATMENT

PROCESSES;

(V) MAINTAINS SHIFT LOG AND RECORDS METER
AND GAUGE READINGS;

(VI) COLLECTS SAMPLES AND PERFORMS ROUTINE
LABORATORY TESTS AND ANALYSES;

(VII) PERFORMS ROUTINE MAINTENANCE

FUNCTIONS AND CUSTODIAL DUTIES;

(VIII) OPERATES POWER GENERATING

EQUIPMENT;

(IX) MAKES SOME OPERATING DECISIONS IN
ABSENCE OF SUPERVISORY PERSONNEL; AND

(X) MAY PERFORM DUTIES OF THE SHIFT

SUPERVISOR.

(6)  "OPERATOR" MEANS A PERSON, WORKING IN A
WATER OR WASTEWATER WORKS OTHER THAN THE SUPERINTENDENT, WHO
IS:

(I)  INVOLVED IN THE ACTUAL OPERATION OF:

(A)  A WATERWORKS, INCLUDING THE
CONTROL OF FLOW, PROCESSING, AND DISTRIBUTION OF WATER; OR

(B)  A WASTE-WATER WORKS, INCLUDING
THE COLLECTION, CONTROL OF FLOW, PROCESSING, AND DISCHARGE
OF WASTE-WATER AND EFFLUENT; OR

(C)  AN INDUSTRIAL WASTE-WATER WORKS,
INCLUDING THE CONTROL OF FLOW, PROCESSING, AND DISCHARGE OF
INDUSTRIAL WASTE-WATER AND EFFLUENT; OR

(II)  WHO PERFORMS SUCH OTHER DUTIES WHICH
ARE NORMALLY CARRIED OUT, OR MAY BE ASSIGNED BY THE
SUPERINTENDENT FROM TIME TO TIME, TO OPERATE THE WORKS IN AN
ORDERLY AND SAFE MANNER.

(7)  "INDUSTRIAL OPERATOR" MEANS A PERSON,
WORKING IN AN INDUSTRIAL WASTE WATERWORKS OTHER THAN THE
SUPERINTENDENT, WHO OPERATES THE CONTROLS AND MAINTAINS LOGS
OF A TREATMENT FACILITY TO REGULATE FLOW AND QUALITY OF THE
EFFLUENT.

(7) (8) "SECRETARY" MEANS THE SECRETARY OF THE
DEPARTMENT OF HEALTH AND MENTAL HYGIENE.

(c) (1) The [State Board of Health and Mental Hygiene]
SECRETARY shall adopt and enforce [such] rules and
regulations as may be necessary for the administration of
this section. The rules and regulations shall include but
