Board, as well as the office of Bank Commissioner and the
Banking Board, see Subtitle 4 of this title.
SUBTITLE 4. TERMINATION OF CERTAIN PROVISIONS.
2-401. BANK COMMISSIONER.
SUBJECT TO THE EVALUATION AND REESTABLISHMENT
PROVISIONS OF THE REGULATORY PROGRAMS EVALUATION ACT OF
1978, THE PROVISIONS OF THIS ARTICLE THAT CREATE THE OFFICE
OF THE BANK COMMISSIONER OR RELATE TO THE POWERS AND DUTIES
OF THE BANK COMMISSIONER AND ANY REGULATIONS ADOPTED UNDER
THESE PROVISIONS SHALL TERMINATE AND BE OF NO EFFECT AFTER
JULY 1, 1982.
REVISOR'S NOTE: This section is new language that
combines the provisions of Art. 11, §§ 26A, 37A,
52A, 61B, 62B, 108K, 117A, 162A, and 223A, as
they relate to the Bank Commissioner.
The broad reference to "the provisions of this
article" is substituted for the specific list of
sections and subtitles of present Art. 11. The
Commission to Revise the Annotated Code notes
that this substitution expands the applicability
of this termination provision. For example, none
of those provisions of the Corporations and
Associations Article that relate to powers and
duties of the Bank Commissioner presently are
subject to termination. To the extent that these
provisions are incorporated into this article,
under this revised section, they are subject to
termination. This and other similar changes,
however, appear to be in keeping with the intent
of the General Assembly as to a thorough review
of regulatory agencies.
See also General Revisor's Note to this subtitle.
