LAWS OF MARYLAND
Ch. 33
A MEMBER OF THE BANK REGULATIONS BOARD:
(1) MAY NOT RECEIVE COMPENSATION; BUT
(2) IS ENTITLED TO REIMBURSEMENT FOR EXPENSES
UNDER THE STANDARD STATE TRAVEL REGULATIONS, AS PROVIDED IN
THE STATE BUDGET.
REVISOR'S NOTE: This section is new language derived
without substantive change from the references in
Art. 11, §§67 and 72 to the composition of the
Bank Regulations Board.
As to subsection (a)(3) of this section, present
Art. 11, § 72 does not refer to the "advice of
the Secretary"; however, that requirement appears
in the otherwise identical provisions of present
Art. 11, § 67, and, therefore, is retained in
this revision.
Subsection (c)(2) of this section is standard
language added to provide for gaps in membership
by indicating that a member serves until a
successor takes office. This provision is
supported by the cases of Benson v. Mellor, 152
Md. 481 (1927) and Grooms v. LaVale Zoning Board,
27 Md. App. 266 (1975).
Subsection (c)(3) of this section also is
standard language added to provide, in effect,
that if a member is appointed after a term has
begun, the member completes the rest of the term
already begun — rather than beginning a new
term.
Subsection (d) of this section is new language
added to conform with actual practice.
See also revisor's note to § 2-301 of this
subtitle.
2-303. POWERS AND DUTIES.
IN ADDITION TO ANY OTHER POWERS AND DUTIES PROVIDED BY
LAW, THE BANK REGULATIONS BOARD HAS THE POWERS AND SHALL
PERFORM THE DUTIES SET FORTH IN TITLE 5, SUBTITLE 4 AND §
5-504 OF THIS ARTICLE.
REVISOR'S NOTE: This section is new language added to
provide a general cross reference to the specific
powers and duties for which the Board was
created, as set forth in present Art. 11, §§ 67
and 72.
GENERAL REVISOR'S NOTE:
As to the possible termination of the Bank Regulations
