Article 49B - Human Relations Commission

12A.

IT IS UNLAWFUL FOR ANY PERSON TO AID, ABET, INCITE,
COMPEL, OR COERCE OR TO ATTEMPT, DIRECTLY OR INDIRECTLY,
ALONE OR IN CONCERT WITH OTHERS, TO COMMIT ANY ACT DECLARED
BY THIS ARTICLE TO BE AN UNLAWFUL PRACTICE; OR TO OBSTRUCT
OR PREVENT ANY PERSON FROM COMPLYING WITH THE PROVISIONS OF
OR ANY ORDER ISSUED PURSUANT TO THIS ARTICLE.

15.

For the purpose of this subtitle:

(H) THE TERM "PHYSICAL OR MENTAL HANDICAP" DOES NOT
INCLUDE ANY INDIVIDUAL WHOSE ALCOHOL OR DRUG ABUSE INCLUDES
INDIVIDUALS WHO ARE OR HAVE BEEN ABUSERS OF ALCOHOL OR
DRUGS, EXCEPT WHERE SUCH USE PREVENTS THE INDIVIDUAL FROM
PERFORMING THE DUTIES OF THE JOB IN QUESTION OR WHOSE
EMPLOYMENT, BY REASON OF SUCH ALCOHOL OR DRUG ABUSE, WOULD
CONSTITUTE A DIRECT THREAT TO THE PROPERTY OR SAFETY OF
OTHERS.

19.

(b) For purposes of this subtitle:

(8) THE TERM "PHYSICAL OR MENTAL HANDICAP" DOES
NOT INCLUDE ANY INDIVIDUAL WHO IS AN ABUSER OF ALCOHOL OR
DRUGS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.

Pensions - Definitions

FOR the purpose of including the Employees' Pension System
and the Teachers' Pension System in the definition of
"plan" under the certain provisions of law relating to
pensions and fiduciary responsibilities.
