FOR the purpose of prohibiting the sale, trade, barter or
exchange of live fox, skunk, or raccoon or skunk as
household pets; providing that fox, skunk, or raccoon
or skunk may be sold, traded, bartered or exchanged
under certain conditions, and providing a penalty.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 - Crimes and Punishments

70D.

(A)  A PERSON MAY NOT OFFER FOR SALE, TRADE, BARTER OR
EXCHANGE AS A HOUSEHOLD PET ANY LIVE FOX, SKUNK, OR RACCOON
OR SKUNK. HOWEVER, A PERSON MAY OFFER FOR SALE, TRADE,
BARTER OR EXCHANGE TO A PUBLIC 200, PARK, MUSEUM, OR
EDUCATIONAL INSTITUTION FOR EDUCATIONAL, MEDICAL,
SCIENTIFIC, OR EXHIBITION PURPOSES A FOX, SKUNK, OR RACCOON
OR SKUNK.

(B)  ANY PERSON VIOLATING THIS SECTION SHALL BE GUILTY
OF A MISDEMEANOR AND UPON CONVICTION, IN THE CASE OF AN
INDIVIDUAL, SHALL BE FINED NOT MORE THAN $1,000; OR IN THE
CASE OF ANY PERSON OTHER THAN AN INDIVIDUAL, BY A FINE OF
NOT MORE THAN $10,000.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.
