FOR the purpose of authorizing the Board of County
Commissioners of Washington County to acquire by
purchase, gift, or condemnation any real, personal, or
leasehold property, or any interest therein, that is
needed in the acquisition, construction, or maintenance
of railroad lines in the county; aha authorizing a
contribution by the Board to the cost of any such
railroad line built by the State of Maryland; providing
that before any railroad line is acquired or
constructed and before any real or personal property
interest is acquired for the railroad line or before
any such contribution is made, the Board shall follow
certain procedures; making this Act an emergency
measure; and generally relating to the acquisition and
construction of railroad lines in Washington County.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 25 - County Commissioners

251.

(A)  THE BOARD OF COUNTY COMMISSIONERS OF WASHINGTON
COUNTY MAY ACQUIRE BY PURCHASE, GIFT, OR CONDEMNATION ANY
REAL, PERSONAL, OR LEASEHOLD PROPERTY, OR ANY INTEREST
THEREIN, THAT IS NEEDED IN THE ACQUISITION, CONSTRUCTION, OR
MAINTENANCE OF RAILROAD LINES IN THE COUNTY.

(B)  BEFORE ANY RAILROAD LINE IS ACQUIRED OR
CONSTRUCTED AND BEFORE ANY REAL, PERSONAL, OR LEASEHOLD
PROPERTY INTEREST IS ACQUIRED FOR THE PURPOSES OF THE
RAILROAD LINE, THE BOARD OF COUNTY COMMISSIONERS SHALL:

(1)  DETERMINING DETERMINE, AS EVIDENCED BY ITS
RESOLUTION DULY PASSED, THAT THE RAILROAD LINE WILL
CONTRIBUTE TO THE PRESERVATION AND ATTRACTION OF THE
RAILROAD INDUSTRY TO THE COUNTY AND WILL PROMOTE ECONOMIC
GROWTH IN THE COUNTY; AND

(2)  ADVERTISE AND HOLD A PUBLIC HEARING ON THE
ACQUISITION AND CONSTRUCTION OF THE RAILROAD LINE IN THE
SAME MANNER THE BOARD IS REQUIRED TO ADVERTISE AND HOLD A
PUBLIC HEARING ON THE PURCHASE OF REAL PROPERTY FOR ANY
OTHER PUBLIC PURPOSE.

(C)  IN THE EVENT THAT THE STATE OF MARYLAND THROUGH
ANY OF ITS DEPARTMENTS OR AGENCIES DETERMINES TO BUILD OR
