by the board of trustees, the contributions, with interest,
that the board considers appropriate. In this subsection,
creditable service includes service rendered before the date
this pension system is established, and a "year of service"
means a year or any part of a year, if the part of the year
served is at least equal to the number of days of the
regular session of the General Assembly for that year in
which service credit is requested.]
MEMBERSHIP IN THE PENSION SYSTEM SHALL BE OPTIONAL WITH
THE FOLLOWING WHO RECEIVE AN ANNUAL SALARY:
(I) ELECTED OR APPOINTED OFFICIALS;
(II) EMPLOYEES OF THE GOVERNOR'S OFFICE;
OR
(III) EMPLOYEES OF EITHER HOUSE OF THE
GENERAL ASSEMBLY.
[(d)] (B) On retirement, a salaried State
employee, judge, legislator, or executive official may not
receive benefits under more than one pension system for the
same period of service.

(10) CREDITABLE SERVICE IN THE PENSION SYSTEM MAY NOT
BE GRANTED TO ANY PERSON APPOINTED AS AN OFFICIAL ON OR
AFTER JUNE 1, 1980, FOR THAT PERIOD DURING WHICH THE PERSON
WORKS FEWER THAN 130 DAYS PER YEAR. THIS PROVISION DOES NOT
APPLY TO OFFICIALS OF MUNICIPAL CORPORATIONS.
(11) ANY MEMBER OF THE PENSION SYSTEM WHO HAD
PREVIOUSLY SERVED IN A POSITION AS DESCRIBED IN SECTION
113(3)(A) OF THIS ARTICLE, MAY RECEIVE CREDIT FOR THE PERIOD
OF SUCH SERVICE UPON MAKING IN A SINGLE PAYMENT, THE
CONTRIBUTIONS, WITH INTEREST, WHICH THE BOARD DEEMS
APPROPRIATE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.
