CHAPTER 290

(Senate Bill 209)

AN ACT concerning

State Highway Administration Plats

FOR the purpose of permitting the State Highway
Administration to record property or rights-of-way to
be acquired or granted through microfilm aperture card
copies of plats; establishing standards for microfilm
aperture cards; abolishing the filing fee for State
Highway Administration plats; and allowing the filing
clerk to charge a reasonable fee for reproducing a copy
of the plat.

BY repealing and reenacting, with amendments,

Article - Real Property

Section 3-108(c)(2) and (d) and 3-109

Annotated Code of Maryland

(1974 Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Real Property

3-108.

(c) (2) The plat shall be legible, drawn accurately
and to scale and shall be submitted on linen sheets for
recordation. THE STATE HIGHWAY ADMINISTRATION MAY SUBMIT
SUBSTITUTE MICROFILM APERTURE CARDS SHOWING PROPERTY OR
RIGHTS-OF-WAY TO BE ACQUIRED OR GRANTED. MICROFILM APERTURE
CARDS MUST MEET ARCHIVAL STANDARDS FOR PERMANENT RECORDS.

(d)  Three linen copies of the plat shall be mailed or
delivered to the clerk. The fee is $5 for each set of plats,
except that [the] A fee is [only $1] NOT REQUIRED for [each
plat] PLATS OR MICROFILM APERTURE CARDS showing property or
rights-of-way to be acquired or granted by the State Highway
Administration.
