208 twelve months after such Limitation shall take Effect, equally to be divided between them, and in Case he should not think Proper to Accept of the House and Lott, af.d on the terms af.d My Will is that my said Son or his Executors shall Expose the same to Publick Sale, and the money therefrom arising to be equally^dividbetween my Children by my first Wife, 4.ly I give and bequeath to my said son Joseph Nicholson, and his Heirs, forever Part of a Tract of Land Called Stepney Heath, and also one other Tract of Land called Berwick both joining and lying in Cacaway in Kent County, he paying unto my other Children by my first Wife the Sum of Two thousand five Hundred Pound, in Spanish Milled Dollars at Seven Shillings and Six Pence each, or half Joes at three Pounds each, or any Passing Current money equal to Gold and Silver at the Denominations af.d equally to be divided between them, within two years after my Death, and in Case he does not Chuse to Accept of the Lands af.d on the Terms af.d then and in such Case my Will desire and Intention is that my next Eldest son then living shall have them on the Terms af.d as divised to my Son Joseph af.d And in Case of his Refusal my – my Will is that each of my sons According to Seniority shall have the Refusal of them in manner and form as af.d And in Case all of them refuse them, that then I devise them to my Executor, to be set up at Publick sale she giving a reasonable Notice, And that the money therefrom arising shall be Equally divided between my Children by my first Wife 5,ly My Will and desire is that all my Personal Estate undisposed of, be equally divided between my Children by my first Wife, And my intention in this and all the devises af,d is, that in Case any of my Children should Dye before me, that their Representatives shall have the Portion so left to them Respectively 6.ly I give unto my Son James Nicholson and his Heirs forever my Water Lott lying in Chester Town. 7.ly Whereas by the Fifth Article in this my Will I have devised away all the Residue of my Personal Estate, But my Intention is that my Wife shall have my Carriage and Horses |
