AND FOR WHOM AN EXCEPTION WAS GRANTED FOR FISCAL YEAR
1978-1979 WHOSE PARENTS OR GUARDIANS ARE DOMICILED IN THE
COUNTY.

(2) Notwithstanding [the foregoing] PARAGRAPH
(1) OF THIS SECTION, for fiscal year [1978-1979] 1980-1981
1979-1980 only, the State Superintendent [of Schools may]
SHALL allow a HANDICAPPED child to remain in a [day care]

DAY-CARE center under the jurisdiction of the Mental

Retardation Administration [upon] ON application for good
cause by the county [or Baltimore City] superintendent. The
application for [such] GOOD cause may include [, but is not
limited to,] the lack of:

(I)   [available] AVAILABLE budget funds;
or

(II)  [the lack of appropriate] APPROPRIATE
alternate school placement.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.

FOR the purpose of permitting Mongtomery County to establish
by local law authority for a local agency to invoke
enforcement procedures upon an administrative
determination that an eviction is retaliatory.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
