SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Code of Public Local Laws
of Maryland be repealed, amended, or enacted to read as
follows:
Article 11 - Frederick County
13-14.
In order to assist the county roads engineer in
[formulating] PLANNING road [maintenance and construction]
programs, a county roads board for the county is hereby
created. The appointed members of the board shall advise
the county commissioners [as to any and all matters
pertaining to the county roads, including but not limited to
matters concerning the] IN planning[, construction, repair
and maintenance of county roads or the need thereof] ROAD
PROGRAMS.
13-15.
The county roads board shall consist of [eight] FIVE
members, [five of whom] WHO shall serve without salary for
[a term beginning May 1, 1950, and which shall be
constituted as follows: One for a term of one year; one for
a term of two years; one for a term of three years; one for
a term of four years and one for a term of five years. The
remaining three members shall be the county commissioners.
The president of the county commissioners shall be ex
officio chairman of the county roads board] 5-YEAR STAGGERED
TERMS. THE FIRST APPOINTMENT OF THE BOARD OF COUNTY
COMMISSIONERS UNDER THIS ACT SHALL BE FOR TERMS OF 1 TO 5
YEARS AND THEREAFTER MEMBERS SHALL BE APPOINTED FOR 5-YEAR
TERMS. THE TERMS OF THE PRESENT MEMBERS OF THE ROADS BOARD
SHALL EXPIRE ON THE EFFECTIVE DATE OF THIS ACT, PROVIDED
THAT PRESENT MEMBERS SHALL BE ELIGIBLE FOR REAPPOINTMENT. A
MEMBER OF THE BOARD OF COUNTY COMMISSIONERS SHALL BE AN
ADDITIONAL NONVOTING, EX OFFICIO MEMBER OF THE ROADS BOARD.
THE MEMBERS OF THE ROADS BOARD SHALL SELECT A CHAIRMAN.
[At the expiration of the terms of office of the five
original appointed members, their successors shall be
appointed by the county commissioners to serve for terms of
five years each. The county commissioners, in making
appointments, shall appoint persons solely because of their
character and fitness. Beginning with the year 1951, the
county commissioners shall make appointments so that not
more than three of the appointed members on the county roads
board shall be of the same political party.] Appointments
shall be made so that one member of the county roads board
shall be appointed from each of five geographical areas
composed as follows:
(a) The election districts of Brunswick, Petersville,
Jefferson, Ballenger, Buckeystown and Urbana.
