COUNTY LOCAL LAWS

represented or held out to be obscene; to prohibit the
practice of requiring acceptance of obscene matter on a
condition of sale, allocation, consignment or delivery for
resale of other printed material; to exempt certain conduct
having bona fide scientific, educational and governmental
purposes; to provide for penalties and sanctions for
violation of Chapter; to authorize the State's Attorney to
seek injunctive relief; and to provide for the expiration of
this Act.

Chapter 30

AN ACT to add a new Chapter 2A, title "Administrative
Procedures Act," to the Montgomery County Code 1972, as
amended, to promote uniformity of procedures and protect
administrative due process rights and other legal rights
afforded to parties who utilize and are subject to the
administrative hearing process before specified agencies of
Montgomery County, Maryland; to specify the applicability of
the provisions of this Act to enumerated administrative
and/or quasi—judicial hearings; to define the terms used in
this Chapter; to establish procedures and requirements for
the filing of appeals, complaints, petitions and grievances
in enumerated proceedings and for notification of affected
parties of the filing of the same and scheduling and conduct
of hearings on said proceedings; to set forth pre—hearing
procedure requirements including provisions and requirements
as to the filing of pre—hearing submissions, matters
pertaining to discovery and pre—hearing motions; to set
forth provisions and requirements concerning the nature of
hearings covered by this Act, the rights and duties of the
parties to the proceedings and the rights and authorities of
the hearing authority; to establish procedures and
requirements for the conduct of hearing, evidentiary, voting
and decisional requirements and provide for rehearing and
reconsideration, informal disposition and judicial review of
any final decision of a hearing authority.
