allowance for certain tenants, to permit the County
Executive to waive certain technical requirements of law to
conform with state or federal regulations, to eliminate an
applicant notification requirement, to provide the housing
opportunities commission with certain prerogatives regarding
selection of units to purchase or lease, to subject rental
units to the subsequent sale price requirements and to
authorize Executive Regulations to deal with foreclosure,
and to make certain technical clarifications.

Chapter 32

AN ACT to amend Chapter 11B, title "Contracts,
Purchases and Disposition" of the Montgomery County Code
1972, as amended, by redesignating the Chapter title
"Contracts, Procurement Matters, and Public Ethics"; by
repealing in its entirety Section 11B-44 thereof, title
"interest in Contracts or purchases, generally; penalty" and
by adding in lieu thereof a new Article VIII, title "Ethics
in Public Service and Contracting" to follow immediately
after Section 11B—43 and to provide for a statement of
public policy relating to public employees and contractors
and to prescribe general standards of conduct; to establish
standards of conduct including conflicts of interest; to
require reports of public employees for certain benefits; to
require public contractor's convenant against contingent
fees; to require disclosure, disqualification, prohibition
of ex parte communications and adjustment to certain
quorums; to prohibit gifts and kickbacks; to impose certain
restrictions on employment; to restrict the use of
confidential information; to provide for administrative
provisions including the establishment of an ethics
commission and to provide for its responsibilities and
functions; to require public access to information and
records; to establish a public employee waiver procedure, to
provide civil remedies against those who violate ethical
standards; to provide criminal penalties for violations of
the Article; to repeal Section 2-129, title "Applicability
of Article"; Sections 2-130, title "Conduct prohibited",
Section 2—131, title "Disclosure and nonparticipation
required; ex parte communications"; Section 2—132, title
"Effect of disqualifications in quorum" and Section 2-133,
title "Ethics Commission" all of Article VIII, title "Code
of Ethics" of Chapter 2, title "Administration" of the
Montgomery County Code 1972, as amended; to redesignate the
aforesaid Article VIII "Code of Ethics" as "Fair Campaign
Practices"; and to recodify Chapter 20A, title "Financial
Disclosure" of the Montgomery County Code, 1972, as amended,
as Subtitle IV hereof, title "Financial Disclosure" and
renumber its component sections and adjust its text to
conform with the numbering sequence of Chapter 11B.
