(b) These provisions shall be
inapplicable in the following circumstances:
(1) With respect to laboratories
and other areas in which a lower
temperature is necessary to the maintenance
of heat sensitive equipment or processes,
or is required by a manufacturer's
equipment warranty;
(2) Where necessary to protect
animal or other than ornamental plant life
or perishable materials; and
(3) With respect to hospitals and
related institutions or other health care
facilities.
(c) In the event of a conflict between
the provisions of this paragraph and the
requirements of a curtailment plan adopted by a
utility pursuant to curtailment policies adopted
by the Federal Department of Energy, the Federal
Energy Regulatory Commission or the Maryland
Public Service Commission, the latter
requirements shall apply.
7. (a) The Executive Order of February 22,
1977 relating to heating limitations in public
buildings is hereby rescinded and replaced with
the following: Subject to the provisions of
subparagraphs b and c hereof, in all parts of
buildings owned, leased and occupied for
non-residential purposes by any public entity,
the thermostats for purposes of space heating
shall be maintained at not more than 65 degrees
fahrenheit in working areas and shall be set back
at least five degrees in non-working areas and on
nights, weekends, holidays and other periods in
which the building is not in ordinary operation.
Systems which operate by reheat heating and
chilling elements shall be managed as practicable
to achieve these limits;
(b) These provisions shall be
inapplicable in the following circumstances:
(1) With respect to laboratories
and other areas in which a higher
temperature is necessary to the maintenance
of heat sensitive equipment or processes,
or is required by a manufacturer's
equipment warranty;
