(2)   Where necessary to protect
animal or other than ornamental plant life
or perishable materials; and

(3)   With respect to hospitals and
related institutions or other health care
facilities.

(c) In the event of a conflict between
the provisions of this paragraph and the
requirements of a curtailment plan adopted by a
utility pursuant to curtailment policies adopted
by the Federal Department of Energy, the Federal
Energy Regulatory Commission or the Maryland
Public Service Commission, the latter
requirements shall apply.

8.    All street lighting not essential for
public safety on public parking lots or along
roads and highways subject to the jurisdiction of
the State or local government shall be
extinguished. Determination of which lighting on
such parking lots and along such roads and
highways is not essential for public safety shall
be made by the State Highway Administration with
respect to roads and highways subject to its
jurisdiction, and by local governments with
respect to their roads and highways.

9.    In accordance with Article 41, Section
15B(c-l) of the Annotated Code of Maryland any
person violating this Order shall be subject to a
civil penalty not to exceed $1,000 for each
violation imposed and collected by a court having
jurisdiction in lieu of the criminal penalties
provided for in Section 15B(g) of that Article.

WHEREAS, The regulation and promotion of the racing industry
has been a matter of continuing concern in Maryland;
and

WHEREAS, It has been estimated that Maryland is the fourth
ranking State in the production of harness as well as
thoroughbred horses and the related investment in land,
facilities and breeding stock in the State was
estimated in 1970 as involving over 47,000 acres and 90
