a statewide automated income maintenance system in
order to effectively achieve the purposes of its public
assistance, medical assistance, and food stamp
programs. For purposes of this Order, "public
assistance" does not include Emergency Assistance,
Emergency Assistance to Families with Children, or
Foster Care Payments.
2. In accordance with Section 3(b) of Article 88A,
the following functions currently assigned to local
departments of social services by statute or
administrative directive are transferred to the Social
Services Administration of the Department of Human
Resources:
A. Determination of the eligibility of
applicants for public assistance programs
pursuant to Sections 52 and 71 of Article 88A.
B. Determination of the amount of assistance
to be granted to eligible applicants pursuant to
Sections 52 and 71 of Article 88A.
C. Determination of the eligibility of
applicants for medical assistance.
D. Determination of the eligibility of
applicants for food stamps pursuant to Section 88
of Article 88A.
E. Reconsideration of the amount of assistance
grants to public assistance recipients, pursuant
to Section 54 of Article 88A.
F. Maintenance of a master file of data
concerning participation in the income
maintenance programs.
G. Issuance of notices to applicants for or
recipients of income maintenance concerning
eligibility, amount of benefits, notification of
adverse action and similar notifications.
H. Issuance of income maintenance benefits,
including authorization to participate in the
food stamp program to eligible applicants and
recipients.
3. The provisions of Sections 53 and 74 of Article
88A, and any rules or regulations adopted pursuant
thereto, shall apply to the decisions of the Social
Services Administration made pursuant to these
transferred functions.
