Secretary of a department to effect reorganization with
the department;

NOW, THEREFORE, I, BLAIR LEE III, ACTING GOVERNOR OF THE
STATE OF MARYLAND, BY VIRTUE OF THE AUTHORITY VESTED IN
ME BY ARTICLE II, SECTION 6 OF THE MARYLAND
CONSTITUTION AND BY ARTICLE 41, SECTIONS 15CA AND 15CB
OF THE ANNOTATED CODE OF MARYLAND, DO HEREBY PROCLAIM
THE FOLLOWING EXECUTIVE ORDER, EFFECTIVE IMMEDIATELY:

1.  There is a Railroad Administration in the
State Department of Transportation.

2.  The head of the Administration is the
Railroad Administrator, who shall be appointed by
the Secretary, with the approval of the Governor.

3.  Subject to the authority of the Secretary,
the Administrator has responsibility for:

(a)  Coordination of the development and
participation in the implementation of
departmental policies and plans necessary for the
preservation, improvement, or provision of
railroad transportation facilities and services;

(b)  Direction of the activities required
to implement functions of the office.

4.  The Administrator shall:

(a)  Participate in the Transportation
Policy Planning process by:

(1)  Recommending departmental goals
and policies relating to railroad transportation.

(2)  Reviewing Federal and State
legislation regarding railroad passenger and
freight service and departmental long-range
railroad transportation planning and other
activities, and recommending action to modify
goals and policies.

(b)  Participate in the Transportation
Systems Planning process by:

(1)  Developing and maintaining the
State Rail Plan as an element of the Maryland
Transportation Plan.

(2)  Assisting in the development of
the Regional and Subregional Person
Transportation Plan and the Interregional Person
