LAWS OF MARYLAND

Ch. 744

(1)    THE MAYOR OF THE CITY OF BALTIMORE, THE
COUNTY EXECUTIVES OF ANNE ARUNDEL, BALTIMORE, HARFORD, AND
HOWARD COUNTIES, THE PRESIDENT OF THE BOARD OF COUNTY
COMMISSIONERS OF CARROLL COUNTY, AND THE CHAIRMAN OF THE
REGIONAL PLANNING COUNCIL SHALL EACH BE A MEMBER OF THE
BOARD. EACH OF THESE OFFICERS MAY NOMINATE, CONSTITUTE, AND
APPOINT A PERMANENT ALTERNATE TO SERVE IN THE ABSENCE OF
THAT MEMBER. THESE OFFICERS ARE AUTHORIZED BY UNANIMOUS
AGREEMENT TO CREATE THIS COMMISSION.

(2)    THE GOVERNOR SHALL APPOINT ONE PUBLIC
MEMBER TO THE BOARD, AND THIS MEMBER SHALL HAVE AN INTEREST
IN THE CULTURAL ACTIVITIES OF THE REGION AND BE A RESIDENT
OF THE REGION.

(3)    THE SPEAKER OF THE HOUSE SHALL APPOINT A
MEMBER OF THE HOUSE OF DELEGATES TO THE BOARD AND THE
PRESIDENT OF THE SENATE SHALL APPOINT A MEMBER OF THE SENATE
TO THE BOARD. BOTH THE DELEGATE AND THE SENATOR SHALL BE
REPRESENTATIVES OF LEGISLATIVE DISTRICTS WITHIN THE REGION.

(4)    THE CHAIRPERSON OF THE ADVISORY COUNCIL
SHALL BE A MEMBER OF THE BOARD.

(5)    THE REGIONAL PLANNING COUNCIL SHALL SELECT
FROM AMONG ITS MEMBERSHIP ONE PERSON WHO SHALL BE A MEMBER
OF THE BOARD.

(6)    THE SECRETARY OF STATE PLANNING, THE
SECRETARY OF        ECONOMIC AND COMMUNITY DEVELOPMENT, THE
CHAIRMAN OF THE    MARYLAND ARTS COUNCIL, AND THE MEMBERS OF
THE REGIONAL CULTURAL ADVISORY COUNCIL SHALL SERVE AS EX
OFFICIO MEMBERS    OF THE BOARD AND MAY APPOINT ALTERNATES TO
SERVE IN THEIR    ABSENCE. AN EX OFFICIO MEMBER DOES NOT HAVE
VOTING RIGHTS.

(C)    EACH BOARD MEMBER, OTHER THAN THOSE SPECIFIED IN
SUBSECTION (B) (1) , SHALL SERVE FOR A TERM OF 4 YEARS.
HOWEVER, THE SENATOR AND DELEGATE SHALL INITIALLY SERVE ONLY
FOR THE REMAINING PERIOD OF THEIR ELECTIVE TERM OF OFFICE.
AFTER THE NEXT ELECTION, THE APPOINTMENT OF A SENATOR AND
DELEGATE SHALL BE MADE IN THE ESTABLISHED MANNER AND THE
SENATOR AND DELEGATE SHALL SERVE A TERM WHICH COINCIDES WITH
THEIR ELECTIVE TERM OF OFFICE.

(D)    AT THE ANNUAL MEETING OF THE BOARD, THE BOARD
SHALL ELECT FROM AMONG ITS MEMBERSHIP A CHAIRPERSON, VICE
CHAIRPERSON, AND A SECRETARY-TREASURER. ALL ACTIONS SHALL
BE TAKEN BY A MAJORITY VOTE OF THOSE VOTING MEMBERS PRESENT
AT A MEETING AND EACH MEMBER HAS ONE VOTE. THE MEMBERS OF
THE BOARD SHALL BE REIMBURSED FOR ACTUAL EXPENSES
NECESSARILY INCURRED IN THE PERFORMANCE OF THEIR DUTIES;
PROVIDED THAT ANY REIMBURSEMENT IS MADE SOLELY FROM FUNDS
PROVIDED UNDER THE AUTHORITY OF THIS SUBTITLE.
