194.

(P) (1) THE PROVISIONS OF THIS SUBSECTION ONLY
APPLY TO CALVERT COUNTY.

(2)    THE COUNTY COMMISSIONERS SHALL APPOINT A
DOG WARDEN AND MAY APPOINT DEPUTY WARDENS. THE DOG WARDEN
AND ANY DEPUTIES APPOINTED SHALL SERVE AT THE DISCRETION OF
THE COUNTY COMMISSIONERS AND SHALL BE PAID WHATEVER SALARY
AND ALLOWANCES FOR TRAVEL THE COMMISSIONERS PRESCRIBE.
BEFORE ENTERING UPON THE DUTIES OF THE OFFICE, THE DOG
WARDEN AND ANY DEPUTY DOG WARDENS APPOINTED SHALL GIVE BOND
TO THE STATE WITH GOOD AND SUFFICIENT SURETY, TO BE
APPROVED BY THE COMMISSIONERS, IN WHATEVER PENALTY THE
COMMISSIONERS DETERMINE AND CONDITIONED ON THE FAITHFUL
PERFORMANCE OF DUTIES AND PROPER ACCOUNTING FOR ALL MONEYS
AND PROPERTY RECEIVED BY VIRTUE OF THE POSITION. THE BOND
SHALL BE IN THE FORM OF A "PUBLIC EMPLOYEE'S FAITHFUL
PERFORMANCE BLANKET BOND" FOR THE DOG WARDEN AND ALL
DEPUTIES, IF POSSIBLE. THE PREMIUMS SHALL BE BORNE BY
CALVERT COUNTY, AND THE BONDS SHALL BE FILED AND RECORDED IN
THE OFFICE OF THE CLERK OF THE CIRCUIT COURT OF THE COUNTY.

(3)    THE COUNTY COMMISSIONERS MAY CONSTRUCT OR
LEASE, OPERATE AND MAINTAIN A DOG POUND FOR AND IN CALVERT
COUNTY. THE COST OF THE POUND AND OF ITS OPERATION SHALL BE
BORNE BY THE COUNTY. IN THEIR DISCRETION, THE COUNTY
COMMISSIONERS MAY ENTER INTO AGREEMENTS WITH ADJACENT
COUNTIES FOR THE ESTABLISHMENT OF A DOG POUND TO SERVE ALL
OF THOSE COUNTIES.

197.

(A) All moneys arising from the dog licenses or taxes
shall be kept in a separate fund by the treasurer of the
respective counties, or tax collecting office thereof, and
shall be used for the payment of damages for the injury and
killing of sheep, poultry or other livestock in the
respective counties, according to the procedures set out in
§ 198 of this article. In the event [the same] THERE are
[not sufficient] INSUFFICIENT FUNDS for the payment of all
damages the damages shall be paid in the order the claims
are presented, and any person or persons whose claims are
not paid in any one year by reason of the lack of money to
the credit of the fund, which is to be designated "the dog
license fund," shall be paid out of the first money coming
into the fund after his claim is reached, and shall be paid
in the order in which the claims are proved and filed; and
any claims now filed and passed upon, but remaining unpaid,
shall have preference over any new claims in the order of
payment. The county commissioners of the several counties
[are hereby authorized to] MAY expend any funds in excess of
[one thousand dollars ($1,000)] $1,000 remaining in the
hands of the treasurer or the tax collecting officer after
the payment of the claims [as aforesaid,] for any public
purpose which, in their judgment[,] may seem right and
