GOVERNOR, WITH THE ADVICE AND CONSENT OF THE SENATE, FROM A

LIST OF FIVE PERSONS SUBMITTED BY THE MEMBERS OF THE MASTER
PLUMBERS ASSOCIATION RESIDING IN CALVERT COUNTY. MEMBERSHIP

ON THE BOARD SHALL BE RESTRICTED TO PERSONS WHO ARE

REGISTERED MASTER PLUMBERS ENGAGED IN THE PLUMBING BUSINESS

IN CALVERT COUNTY FOR AT LEAST 3 YEARS PRECEDING THEIR

APPOINTMENT. TERMS OF MEMBERS SHALL BE FOR 2__YEARS AND

MEMBERS APPOINTED__TO FILL VACANCIES OCCURRING DURING ANY

TERM SHALL HOLD OFFICE FOR THE UNEXPIRED PORTION OF TERM.
THE MEMBERS OF THE BOARD SHALL APPOINT AN INSPECTOR OF
PLUMBING, WHO SHALL RECEIVE WHATEVER COMPENSATION AS THE
CALVERT COUNTY PLUMBING BOARD SHALL SET. THE INSPECTOR'S
COMPENSATION SHALL BE PAID FROM THE FEES OF APPLICANTS FOR
CERTIFICATES OR PERMITS, AND MAY NOT EXCEED THE SUM OR SUMS

SO COLLECTED. THE BOARD SHALL SET ALL FEES AND MAKE ALL

REGULATIONS PERTAINING TO THE PLUMBING BUSINESS IN CALVERT
COUNTY.

(B)   THE PLUMBING BOARD SHALL PROMULGATE A SYSTEM OF
RULES AND REGULATIONS AND SUBMIT FOR ADOPTION THOSE RULES
AND REGULATIONS TO THE COUNTY COMMISSIONERS. PRIOR TO THEIR
ADOPTION, THE PULES AND REGULATIONS SHALL BE PUBLISHED ONCE
EACH WEEK FOR 3 CONSECUTIVE WEEKS IN EACH OF THE CALVERT
COUNTY NEWSPAPERS. THE COMMISSIONERS SHALL PROVIDE FOR A

PUBLIC HEARING ON THE RULES AND REGULATIONS AND SHALL

PUBLISH NOTICE OF THE DAY AND TIME OF THE HEARING AT THE

SAME TIME THE RULES AND REGULATIONS ARE PUBLISHED. THE

PURPOSE OF THE HEARING IS TO HAVE THE COMMISSIONERS OBTAIN
THE BENEFIT OF THE PUBLIC'S VIEWS AND OPINIONS PRIOR TO
FINAL ADOPTION.

(C)  (1) ALL PERSONS WHO ARE LICENSED BY THIS STATE AS

A MASTER OR A JOURNEYMAN PLUMBER, AND ALL FIRMS AND

CORPORATIONS WHOSE OFFICERS, AGENTS, OR EMPLOYEES ARE SO

LICENSED, ENGAGED, OR ABOUT TO ENGAGE, IN THE PLUMBING

BUSINESS IN CALVERT COUNTY ARE REQUIRED TO REGISTER WITH THE

BOARD AND POST A BOND IN THE AMOUNT OF $1,000. THE BOND

SHALL BE CONDITIONED ON THE FAITHFUL PERFORMANCE OF ALL WORK
CONTRACTED FOR BY THESE REGISTERED PERSONS, FIRMS, OR

CORPORATIONS AND SHALL PROTECT AND SAVE HARMLESS ALL THOSE

WHO EMPLOY, OR WHO CONTRACT FOR THE SERVICES OF, THESE

REGISTERED PERSONS, FIRMS, OR CORPORATIONS FROM LOSS OR

DAMAGES RESULTING FROM THE USE OR INSTALLATION OF DEFECTIVE
MATERIALS OR FROM WORK NOT DONE IN WORKMAN-LIKE MANNER. ANY

CAUSE OF ACTION ARISING UNDER THIS SECTION SHALL BE

INSTITUTED WITHIN 1 YEAR FROM THE DATE OF THE INSTALLATION
OF MATERIALS OR THE PERFORMANCE OF THE WORK OR SERVICES.

(2) ANY PERSON, FIRM, OR CORPORATION WHO

PRACTICES OR ENGAGES IN THE WORK OF A MASTER OR JOURNEYMAN

PLUMBER WITHOUT HAVING COMPLIED WITH THE PROVISIONS OF THIS

SECTION AND ANY PERSON NOT LICENSED AS A MASTER OR

JOURNEYMAN PLUMBER WHO DOES OR PERFORMS ANY WORK OF THAT
NATURE EXCEPT UNDER THE DIRECTIONS OF A MASTER OR JOURNEYMAN

PLUMBER OR WHO VIOLATES ANY OF THE PROVISIONS OF THIS

SECTION, IS GUILTY OF A MISDEMEANOR AND, UPON CONVICTION,
SHALL BE FINED NOT LESS THAN $25 NOR MORE THAN S1,000.
