(2) IN WASHINGTON COUNTY THE CLERK OF THE
CIRCUIT COURT MAY NOT ISSUE A NEW LICENSE UNDER THIS SECTION
ARTICLE UNTIL THE APPLICANT FILES WITH THE CLERK A
CERTIFICATION FROM THE COUNTY PLANNING COMMISSION THAT THE
LOCATION DESIGNATED IN THE APPLICATION IS PROPERLY ZONED OR
HAS A SPECIAL EXCEPTION FOR THE TYPE OF BUSINESS THAT THE
APPLICANT PROPOSES TO OPERATE. THIS CONDITION DOES NOT
APPLY IN THE CASE OF AN APPLICATION FOR A RENEWAL OR
REISSUANCE OF A LICENSE PREVIOUSLY ISSUED BUT DOES APPLY TO
A TRANSFER OF A LICENSE PREVIOUSLY ISSUED FROM ONE LOCATION
TO ANOTHER LOCATION. THE PROVISIONS OF THIS SECTION DO NOT
APPLY TO LOCATIONS WHICH ARE NOT SUBJECT TO THE WASHINGTON
COUNTY ZONING ORDINANCE.
[(1)] (3) [In Washington County,] FOR ALL OTHER
LICENSES, the clerk of the Circuit may not issue a new
license under—this—section until the applicant files with
the clerk a certification from the county planning
commission or the appropriate municipal zoning authority
that the location designated in the application is—properly
zoned or has a special exception for the type of business
that the applicant proposes to operate.-----This condition does
not apply in the case of an application for a renewal or
reissuance of a—license previously issued.
[(2)] (4) The zoning authority of each
Municipality in Washington County shall furnish the county
planning commission with—copies of its current—zoning
special exception to the zoning map.
[(3)] (5) A certification made by the Washington
County planning commission with respect to a location within
the boundaries of a—municipality shall be based on the
current information furnished by the appropriate
municipality.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.
