bids[, and, if]- IF in its discretion the prices quoted are
unreasonable, [it] THE COMMISSION may readvertise the work
or any part of it, or may do any part or all of the work by
day labor[; provided that]. AT any time the commission may,
in its discretion, expend by day labor for construction work
an amount not exceeding $15,00 0 without advertising or
receiving bids. THE COMMISSION, BY RESOLUTION AND
IMPLEMENTING REGULATIONS, MAY ESTABLISH A MANDATORY MINORITY
BUSINESS UTILIZATION POLICY TO FACILITATE THE PARTICIPATION
OF RESPONSIBLE MINORITY BUSINESS FIRMS IN CONTRACTS AWARDED
BY THE COMMISSION IN ACCORDANCE WITH COMPETITIVE BIDDING

PROCEDURES. AFTER THE 2-YEAR PERIOD OF ANY___PROGRAM

ESTABLISHED, THE COMMISSION SHALL ISSUE A REPORT CONCERNING
THE IMPLEMENTATION AND ADMINISTRATION OF THE PROGRAM
TOGETHER WITH ANY APPROPRIATE RECOMMENDATIONS. FOR THE
PURPOSE OF THIS SUBSECTION, "MINORITY BUSINESS FIRM" MEANS A
BUSINESS FIRM AT LEAST 50 PERCENT OF WHICH IS OWNED BY
MINORITY GROUP MEMBERS, OR, IN THE CASE OF A PUBLICLY OWNED
BUSINESS, AT LEAST 51 PERCENT OF THE STOCK OF WHICH IS OWNED
BY MINORITY GROUP MEMBERS. "MINORITY GROUP MEMBERS"
INCLUDES FEMALES, BLACKS (NOT OF HISPANIC ORIGIN),
HISPANICS, AMERICAN INDIANS, ALASKAN NATIVES, ASIANS, AND
PACIFIC ISLANDERS.

(B) All [such] contracts may be protected by [such]
bonds, penalties, and conditions [as] REQUIRED BY the
commission [shall require], all of which [shall be] ARE
enforceable in any court having jurisdiction.

SECTION 2. AND BE IT FURTHER ENACTED, That if any
provision of this Act, including any class provided for
under subsection 3—2(b) (a), or the application thereof to
any person or circumstance is held invalid for any reason in
a court of competent jurisdiction, the invalidity does not
affect other provisions or any other application of this Act
which can be given effect without the invalid provision or
application, and for this purpose the provisions of this Act
are declared severable.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 19 79. It shall remain effective
for a period of 2 years and, at the end of June 30, 1981,
and with no further action required by the General Assembly,
this Act shall be abrogated and of no further force and
effect.
