DUE BY USING A FACTOR THAT THE COMPTROLLER DEVELOPS THROUGH
SURVEY OF THE BUSINESS OF THE TAXPAYER, INCLUDING ANY
AVAILABLE RECORDS, THROUGH SURVEY OF OTHER TAXPAYERS OF THE
SAME TYPE, OR THROUGH OTHER MEANS.

(2) THE COMPUTATION SHALL BE PRIMA FACIE
CORRECT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.

AN ACT concerning

Public Service Commission - Transfer of Controlling

Interests

FOR the purpose of requiring prior approval by the Public
Service Commission of any transfer of a controlling
interest in a water company or sewage disposal company;
and setting the condition under which the Commission
may grant its authorization.

BY adding to

Article 78 - Public Service Commission Law

Section 65A

Annotated Code of Maryland

(1975 Replacement Volume and 1978 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 78 - Public Service Commission Law

65A.

(A)   A PERSON MAY NOT TRANSFER A CONTROLLING INTEREST
IN A WATER COMPANY OR SEWAGE DISPOSAL COMPANY TO ANOTHER
PERSON OR GROUP OF PERSONS WITHOUT THE PRIOR AUTHORIZATION
OF THE COMMISSION.

(B)   THE COMMISSION MAY AUTHORIZE SUCH A TRANSFER UPON
A FINDING THAT THE TRANSFER IS CONSISTENT WITH THE PUBLIC
CONVENIENCE AND NECESSITY.
