3-201. MEMBERSHIP.

(A)   COMPOSITION.

THE ALLEGANY COUNTY BOARD CONSISTS OF:

(1)   FIVE VOTING MEMBERS; AND

(2)     THE CHAIRMAN OF THE BOARD OF COUNTY
COMMISSIONERS, WHO IS AN EX OFFICIO NONVOTING MEMBER.

(B)   QUALIFICATIONS.

AN INDIVIDUAL NOMINATED FOR MEMBERSHIP ON THE COUNTY
BOARD SHALL BE A QUALIFIED VOTER AND A RESIDENT OF ALLEGANY
COUNTY FOR AT LEAST 3 YEARS.

(C)   ELECTION OF MEMBERS.

(1) MEMBERS OF THE ALLEGANY COUNTY BOARD SHALL
BE ELECTED:

(I) (1) AT A GENERAL ELECTION AS REQUIRED BY
SUBSECTION (D) OF THIS SECTION; AND

(II) (2) FROM ALLEGANY COUNTY AT LARGE.

(2) IF MORE THAN TWO INDIVIDUALS FILE AS

CANDIDATES FOR EACH VACANCY ON THE BOARD, A PRIMARY ELECTION
SHALL BE HELD.

(D)   TERM; VACANCIES.

(1)    EACH MEMBER SERVES FOR A TERM OF 4 YEARS
BEGINNING ON JANUARY 2 AFTER HIS ELECTION AND UNTIL A
SUCCESSOR IS ELECTED AND QUALIFIES. IF JANUARY 2 IS A LEGAL
HOLIDAY, THE TERM BEGINS ON THE FIRST DAY AFTER JANUARY 2
THAT IS NOT A LEGAL HOLIDAY.

(2)    THE TERMS OF MEMBERS ARE STAGGERED AS
REQUIRED BY THE TERMS OF THE MEMBERS SERVING ON THE COUNTY
BOARD ON JULY 1, 1978.

(3) THE GOVERNOR SHALL APPOINT A NEW MEMBER TO
FILL ANY VACANCY ON THE BOARD FOR THE REMAINDER OF THAT TERM
AND UNTIL A SUCCESSOR IS ELECTED AND QUALIFIES.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 77, §36D(a),
(b) — except the second sentence — and the fourth
sentence of (c) and Art. 77, §36D (d), (e), the
first seven sentences of (f), and the first
sentence of (i).

The second sentence of Art. 77, §36D(a) is
deleted as obsolete.
