prohibitions; to provide for the designation of certain
smoking areas; to require the posting of signs in
smoking and no-smoking areas; to make it unlawful for
one in control of a no-smoking area to permit or allow
smoking in said area; to provide for election by retail
establishments and other facilities not expressly
covered by this Act to apply for coverage and
regulation hereunder; to provide for the County
Executive to adopt rules and regulations for the
implementation of this Act; to provide for penalties
and enforcement of this Act; and to provide for
applicability within incorporated municipalities.

Chapter 34

AN ACT to emend Section 54A-2, title "Prohibited Conduct;
Applicability" of Chapter 54A, title "Transit
Facilities" of the Montgomery County Code, 1972, as
amended, to provide that it shall be unlawful for
passengers or occupants of certain public passenger
vehicles to refuse or fail to pay the established fare.

Chapter 35

AN ACT to amend Chapter 29, title "Landlord—Tenant
Relations" of the Montgomery County Code 1972, as
amended, by repealing and re-enacting with amendments
Section 29-9, title "Created; membership; appointment;
terms of office of members; alternate members" of
Article II, title, "Commission on Landlord-Tenant
Affairs" for the purpose of correcting technical errors
relating to the section.

AN ACT to amend Chapter 29, title "Fair Landlord—Tenant
Relations," of the Montgomery County Code 1972, as
amended; to amend subsection (c) of Section 29-27,
title "Leasing requirements generally" of Article IV,

provisions of this subsection those tenants certified
by the Montgomery County Housing Opportunities
Commission to participate in the federal government's
Section Eight Housing Assistance Payments Program; to
