COUNTY LOCAL LAWS

Chapter 4

AN ACT to amend Chapter 52, title "Taxation," of the
Montgomery County Code 1972, as amended, by repealing
and re-enacting, with amendments, subsection (a) of
Section 52-16B, title "Beverage Container Tax," to
provide that the tax shall be levied and imposed
beginning September 1, 1976.

Approved July 16, 1976.

Chapter 5

AN ACT to amend Chapter 18A, title "Energy Conservation", of
the Montgomery County Code 1972, as amended, by
repealing and re-enacting with amendments Section
18A-5, title "Energy Conservation Advisory Committee;
establishment; terms of office; ex—officio members;
etc.", Section 18A—6, title "Same; meetings; quorum;
voting" and Section 18A—7, title "Same; subcommittees,
advisory committees and task forces" to increase the
membership of the Energy Conservation Advisory
Committee from nine to fifteen members; to specify
terms of office, appointment and election of officers,
meeting procedures and voting requirements for the
committee; to authorize the Committee to appoint
subcommittees, advisory groups and task forces to
assist the Committee in fulfilling its duties.

Approved August 13, 1976.

Chapter 6

AN ACT to amend Chapter 49, title "Streets and Roads", of
the Montgomery County Code 1972, as amended, by
repealing and re-enacting with amendments Section
49-43, subtitle "Waivers of requirements of article" to
delete a waiver requirement for certain moderately
priced developments; to add a new subsection (d) to
permit the County to waive Road Code standards and to
sake temporary road improvements to County public roads
included in approved capital improvement programs upon
written order by the County Executive finding that such
construction is necessary for safety on a County public
road for which no additional right—of-way need be
acquired; to add a new subsection(e) to permit the
County Executive to waive Road Code standards for
certain community development areas; to add a new
subsection (f) to permit the County Executive to waive
Road Code standards for temporary road improvements to
certain County public roads specifically included in
