enforce any of the powers expressly enumerated; and

WHEREAS, the people of Baltimore County in accordance
with the Constitution and laws of the State of Maryland have
adopted, ordained and established the Baltimore County
Charter; and

WHEREAS, pursuant to provisions of the Charter and of
the laws of Maryland, the County is charged with the duty of
planning for the future development and growth of the
County, including the preparation of a Master Plan, the
enactment of rules and regulations governing the control of
building permits, subdivisions and the development of a
zoning map and zoning regulations; and

WHEREAS, pursuant to Title 22 of the County Code, the
County Planning Board is authorized to prepare, adopt and
amend a Master Plan for the physical development of the
County, which will guide the development of the County and
make adequate provision for services and public utilities,
transportation, housing conservation, distribution and
density of population, public and semi-public facilities,
urban redevelopment and rehabilitation, capital programming,
and other elements of County growth and development; and

WHEREAS, pursuant to Title 22 of the County Code,
zoning maps and regulations and subdivision controls are
generally required to be consistant CONSISTENT with a Master
Plan and be designed to facilitate adequate provision for
schools, parks, water, sewerage, transportation and other
public requirements and utilities, to preserve open space,
to control the density of population, to avoid undue
concentration, to reduce traffic congestion, to regulate the
issuance of permits, exceptions and variances, and to
promote public health, safety and welfare; and

WHEREAS, pursuant to Title 22 of the County Code, the
County Council is empowered to adopt such zoning
regulations, subdivision controls and other legislation to
implement a Master Plan including a comprehensive growth
management system elements; and

WHEREAS, pursuant to Title 22 of the County Code, the
County Council has adopted in 1976 a comprehensively revised
version of the county-wide Zoning Map, which under this Act
shall be deemed to constitute the present county-wide Zoning
Map of Baltimore County; now therefore
