(3)   MAINTAIN AND PRESERVE ALL RECORDS, BOOKS,

AND PAPERS OF THE BOARD; AND

(4)    PERFORM ANY OTHER DUTIES ASSIGNED BY THE
BOARD.

(C)   ADDITIONAL STAFF.

ON RECOMMENDATION OF THE EXECUTIVE DIRECTOR, THE BOARD
MAY APPOINT ANY ADDITIONAL STAFF IT DETERMINES NECESSARY TO
CARRY OUT ITS DUTIES.

(D)   MERIT SYSTEM STATUS EMPLOYEES.

(1)    EXCEPT FOR THE EXECUTIVE DIRECTOR AND
PROFESSIONAL EMPLOYEES WHO ARE NOT IN THE CLASSIFIED
SERVICE, EACH EMPLOYEE OF THE BOARD IS SUBJECT TO THE STATE
MERIT SYSTEM LAW.

(2)    EACH EMPLOYEE OF THE BOARD SHALL JOIN THE
STATE TEACHERS' RETIREMENT SYSTEM OR THE STATE EMPLOYEES'
RETIREMENT SYSTEM. HOWEVER, AS AN ALTERNATIVE A
PROFESSIONAL EMPLOYEE MAY JOIN AN OPTIONAL RETIREMENT
PROGRAM UNDER ARTICLE 73B, §110 OF THE CODE.

REVISOR'S NOTE: This section presently appears as Art.
77A, §12(c).

The only changes are in style.

As to the State Merit System Law, see Art. 64A of
the Code.

As to the Teachers' Retirement System, the State
Employees' Retirement System, and the Optional
Retirement Program, see Art. 73B of the Code.

14-105. POWERS AND DUTIES OF BOARD.

(A) IN GENERAL.

IN ADDITION TO ANY OTHER POWERS GRANTED AND DUTIES
IMPOSED BY THIS TITLE, AND SUBJECT TO THE PROVISIONS OF
TITLE 12 OF THIS ARTICLE AND ANY OTHER RESTRICTIONS IMPOSED
BY LAW OR BY ANY TRUST AGREEMENT INVOLVING A PLEDGE OF
PROPERTY OR MONEY, THE BOARD OF TRUSTEES HAS THE POWERS AND
DUTIES SET FORTH IN THIS SECTION.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from the last sentence
of Art. 77A, §12(a). New language is added to
make clear that the powers and duties enumerated
in this section are not exclusive.

Other restrictions on the powers of the Board may
be imposed by certain bond statutes. In this
regard, see the General Revisor's Note to this
