OF TITLE 12 OF THIS ARTICLE AND ANY OTHER RESTRICTIONS
IMPOSED ON THE UNIVERSITY OF MARYLAND BY LAW, OR BY ANY
TRUST AGREEMENT INVOLVING A PLEDGE OF PROPERTY OR MONEY, THE
BOARD OF REGENTS HAS THE POWERS AND DUTIES SET FORTH IN THIS
SECTION.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from the first clause
of Art. 77A, §15(e). New language is added to
indicate that the powers and duties enumerated in
this section are not exclusive.

(B)   POWER TO MANAGE.
THE BOARD OF REGENTS:

(1)    IS RESPONSIBLE FOR THE MANAGEMENT OF THE
UNIVERSITY OF MARYLAND AND HAS ALL THE POWERS, RIGHTS, AND
PRIVILEGES THAT GO WITH THAT RESPONSIBILITY, INCLUDING THE
POWER TO CONDUCT OR MAINTAIN ANY DEPARTMENTS OR SCHOOLS IN
THE UNIVERSITY AT THE LOCATIONS THE BOARD DETERMINES; AND

(2)    MAY NOT BE SUPERSEDED IN ITS AUTHORITY BY
ANY OTHER STATE AGENCY IN MANAGING THE AFFAIRS OF THE

UNIVERSITY.

REVISOR'S NOTE: This subsection presently appears as
the first paragraph of Art. 77A, §15(e), except
the first clause.

The phrase "State agency" is substituted for the
present "State board, bureau, department or
commission" since the latter are, in fact,
"agencies".

The only other changes are in style.

(C)   POWERS UNDER CHARTER.

THE BOARD HAS ALL THE POWERS CONFERRED ON IT BY:

(1)   THE ACT OF INCORPORATION OF THE MARYLAND
STATE COLLEGE OF AGRICULTURE; AND

(2)   THE CHARTER OF THE UNIVERSITY OF MARYLAND.

REVISOR'S NOTE: This subsection presently appears as
the second paragraph of Art. 77A, §15(c).

The only changes are in style.

The third paragraph of present Art. 77A, §15(c),
which permits the Board to maintain the
departments and campuses it determines wise is
deleted as repetitive of the provisions of
present Art. 77A, §15(e) , now subsection (b) (1)
of this section.
